Two men charged with Sh 7.5 Million fraud have been released on bail at Makadara Law Courts.
The two Bashir Ali Gabow and Mohamed Muhamud Abdi have been in custody since March 25,2022 since the court had denied bail.
It took the intervention of lawyer Danstan Omari who made an application before magistrate Apondi to have them released on bond on grounds that the offense is bailable.
“The accused have the constitutional right to be released on bond or bail since they are innocent until proven guilty,”he added.
He told the court that the suspects are not a flight and having them incarcerated since March is such a long time.
The two have been charged that on February 25,2019 at South B in Industrial Area, Makadara Sub County within Nairobi county, Jointly with others not before the court, with intent to defraud, obtained from Amina Elmi Hassan Sh 7,500,000 by falsely pretending that they were capable of selling Akrama Apartment Limited Shares to the said Amina Elmi Hassan knowing it was untrue.
The lawyer watching brief for the victim,Kimani Wachira had opposed their release on bail saying that they are a flight risk and are likely to interfere with the witnesses once released on bail or bond.
“The accused are likely to interfere with witnesses including the victim who is a woman, “added Wachira.
After Omari’s application ,the magistrate released them on Sh 1.5Million cash bail
They were also ordered to report to the OCS industrial area every month, as well as two contact people.
The matter will continue at the end of this month.
