A middle aged man accused of assaulting another one to death at Luthuli-Mfangano Juction in the year 2021, will now be charged with the murder.
Winstone Kaara has appeared in court where a ruling on the inquest into the murder of Joshua Oyonde was delivered.
“I have considered all the applications including the postmortem report and it is evident that the deceased died out of injuries allegedly caused by the suspect, “added Alego.
The matter was forwarded to ODPP on December 2, 2021 for perusal and advice and he directed that the same be placed before a magistrate of competent jurisdiction as an inquest for determination.
It is said that on October 13, 2021 at around 2pm at Stage Number Four, Luthuli –Mfangano junction in Nairobi town, a confrontation ensued between the two.
The deceased was then knocked down by a hand blow on the head and he went unconscious. He later woke up and proceeded home.
The following day he was not feeling well and was taken to a nearby clinic and was given medication for Malaria.
The deceased stayed indoors in his house at Mukuru Kwa Reuben while receiving medication from the said Region medical Centre.
On 22/10/2021 his brother after realizing that he was not getting better, escorted him to Central Police Station to make a report of assault and he continued to stay at home.
On October 28/2021 he succumbed to injuries while at Kenyatta National Hospital.
The suspect will now be charged with murder after the magistrate closed the file and directed that he be charged with murder.
