Nairobi City County Governor Johnson Sakaja has been served with a demand letter over his directive demanding that all liquor outlets operating next to public service terminus be closed.
In a letter dated March 4, 2023, the complainant represented by a human rights defender Charles Mugane, alludes that on February 23, 2024, the Hon. Johnson Sakaja in a meeting held at Charter Hall, Nairobi, issued a blanket and indiscriminate directive for the immediate closure of all wines and spirits outlets operating next to public service terminus and stages in the city within 7 days.
According to the Complainant through Advocate Mugane, the impugned order is illegal, null and void for it displays utter disregard of established constitutional principles of fairness, rationality, justice, public participation and legitimate expectations.
He also alleges that the directive by Governor Sakaja expressly targeted the complainant businesses licenced in accordance with the Law.
He also say that the implementation of the said impugned directive has resulted to the closure of the complainant businesses in the city.
He therefore demands the immediate and unconditional admission of liability together with lifting of the impugned directive within forty-eight hours from today.
Mugane threatens to move to the High Court’s Constitutional and Human Rights division to challenge the directive should Governor Sakaja fail to adhere to the demand letter.
