Sheria Mtaani Rush to court and files another petition to stop DP Gachagua’s impeachment.
A civil society dubbed Sheria mtaani has filed a constitutional petition at the high court seeking to stop the impeachment motion against the deputy president Rigathi Gachagua.
Addressing journalists at Milimani courts in Nairobi,City lawyers Danstan Omari,Kevin Turunga, Shadrack Wambui and Brian Mabeya argued that there are various fundamental rights of the constitutional have been violetd.
According to them,the current status of our national assembly which does not have a two third gender rule cannot discuss any about the impeachment of Rigathi Gachagua.
“You can’t be a referee and at the same time want to officiate a match,what the speaker and his deputy of the national assembly Moses Wetangula and Gladys Boss Shulei have expressed is very wrong,this mean the deputy president Rigathi Gachagua will not get justice”Said Omari
“All the allegations against the deputy president are mere allegations,when someone says Rigathi Gachagua is a tribal leader,that is misleading, remember he has not or never appointmented any cabinet minister or permanent secretary,all those appointments were done by the president “Added Omari
They also added that a president can’t initiate such a motion but it should emanate from the public,
Other grounds of stopping the impeachment motion that is scheduled to be tabled tomorrow including biasness by both the Speaker on National assembly Moses Wetangula and his deputy one Gladys Boss Shulei who said they will support the motion.
“The current parliament in its form can’t discuss the impeachment motion against deputy president Rigathi Gachagua,the issue of two thirds gender rule has never been settled,how can they now then discuss constitutional matters,”Said Wambui
The matter will now be mentioned on the 9th of October for further directions.
