Reprieve for NYERI Nominated MCA Ann Thumbi as the Tribunal Stops UDA from Summoning Her.

Political Parties Dispute Tribunal has suspended the Summons by UDA party against NYERI Nominated MCA Ann Thumbi for allegedly associating herself with DCP and its leader H.E. Rigathi Gachagua, EGH.

This is after Thumbi through her Lawyer Mabeya Moses moved to the Political Parties Dispute Tribunal seeking to overturn that decision pending the hearing and determination of that petition.

She wanted to stop the intended disciplinary proceedings saying that she was not supplied with any evidence that committee relied upon.

“Unless the Tribunal Intervenes, My client risk losing her MCA seat and being denied due process, “added Mabeya.

In an application before the Tribunal, Thumbi says that on June 7, 2025, she received a letter from UDA summoning her to appear its disciplinary committee on June 20, 2025 to respond to allegations concerning her attendance at a DCP rally and alleged incitement.

Mabeya argued that for the removal of a leader from office to materialize, there must be a specific, clear, cogent and conscious rules that govern such procedures and the same cannot be left out to the Whelms of disciplinary Committee.

Thumbi said that her efforts even to serve a notice of objection dated June 20, 2025 were all thwarted with ignorance as the Committee still proceeded with the said hearing ignoring the principles of Natural Justice.

The MCA said the entire process lacked impartiality, transparency, and procedural fairness and was designed to arrive at predetermined outcome.

She wanted the court to intervene to stop that proceeding or else the party will violate her rights and set a dangerous precedent that undermines due process.

Mabeya was seeking an order staying the Decision or outcome of the said disciplinary pending the hearing and determination of this petition.

He was also seeking an order restraining UDA party from removing Thumbi from office or wiping her from committees in the Nyeri County Assembly.

Thumbi had sued UDA and Charles Njenga, the Chairperson of UDA Committee saying that the intended process is illegal.
