Gospel Artiste Holy Dave is facing an assault case at Kibera Law Courts.
Today the Musician appeared before court unrepresented and said he is seeking to settle the matter out of court.
The Artist has pleaded not guilty to an offense of assault and causing actual bodily harm contrary to Section 251 of the penal code.
He is charged that on October 1, 2022 at Gemini Lounge Adlife plaza along ring road Kilimani, unlawfully assaulted a businessman causing him actual bodily harm.
When the matter came before Kibera Magistrate Jacqueline Ojwang, David Musyoki Kimanthi alias Holy Dave said that he is trying to negotiate with the victim to have the matter settled out of court.
“Your Honor, I am trying to pursue an out-of -court settlement, “he said.
Reports indicate that on October 1, 2022, the victim was having fun at the said Lounge together with his two friends and were seated at the VIP section.
The victim who is being represented by Lawyer `Hillary Apollo was not consuming alcohol but his friends were talking. A friend of the victim who was seated at another corner decided to join him at his table but was restrained by a bouncer.
Holy Dave is said to have emerged from a different table and shouted at the victim asking him why he was defending his friend from the security man.
The accused is said to have hit the victim on the left side of his face using a glass of beer (Konyagi) glass and the victim tried to cover his face using a shield he was carrying on his hand.
The victim started bleeding and he sustained a deep cut on the left side of the face near the eye and his clothes were soaked in blood.
The victim was assisted by his friends who used a sweater top to try and stop the bleeding.
The accused and the victim are said to have been escorted by the security guards outside CCTV footage of what happened that day was retrieved by the police.
The matter was reported and Dave was charged. Dave had also reported to police that he sustained injury in the process at his right finger.
Dave is out on Sh 10,000 cash bail.
The matter will be heard on January 23/2023.
