Fifteen officers from the Directorate of Criminal Investigations (DCI) and the National Intelligence Service (NIS) are set to face fresh criminal charges over the alleged abduction and mistreatment of two Indian nationals and their Kenyan driver in Nairobi in 2022.
The suspects have been summoned to appear before the Kahawa Law Courts on September 7, 2026, where they are expected to take plea before Senior Principal Magistrate Njeri Thuku.
The new case comprises 17 charges against the officers, including Peter Gachiku, James Tanki, Joseph Mbugua, David Kipsoi, Joseph Mbaya, John Kamau, Hillary Kipchumba, Stephen Matunda, Simon Gikonyo, Paul Muriithi, Bonface Mtulia, Elikana Mugendi, Fredrick Kamau, John Mavhari and Michael Bett.
Among the offences they are expected to answer are kidnapping with intent to murder, contrary to Section 258 of the Penal Code, and conspiracy to commit a felony under Section 393 of the Penal Code.
The officers also face allegations of subjecting a person to cruel, inhuman or degrading treatment under Section 51(3) of the National Intelligence Service Act, alongside other charges relating to alleged forgery and participation in acts of cruel, inhuman or degrading treatment.
The case arises from events said to have occurred on July 22, 2022, in Nairobi County.
According to the prosecution, the officers, together with other individuals whose identities have not been disclosed, were travelling in four vehicles when they allegedly followed and intercepted a vehicle occupied by Indian nationals Mohammed Zaid Sami Kidwai and Zulfiqar Ahmed Khan, and their Kenyan driver Nicodemus Mwania Mwange.
The prosecution alleges that the three were subsequently subjected to the offences forming the basis of the new case.
The latest charges follow the termination of earlier murder proceedings involving the suspects before the High Court. The prosecution has now brought a separate set of charges based on the evidence it says is available in relation to the 2022 incident.
The case will now move to the Kahawa Law Courts, where the accused officers will be required to respond to the allegations when they appear for plea-taking on September 7.
