A Son to a medical doctor Nisha Sapra charged with manslaughter told police his mother inflicted fatal stab wounds to his father during a domestic quarrel in their bedroom 17 years ago.
Mr Harrison Gikandi told Milimani senior principal magistrate Benmark Ekhubi that Rishi Sapra witnessed his mother stab his father in their bedroom,
“The son who is scheduled to testify in court will give a graphic account of the incident which occured on August 2, 2005,” Gikandi told the court.
Gikandi told the court that he collected a carpet and bedsheets from the bedroom of the deceased as evidence which is opposite their son’s.
The items were handed to a government analyst for DNA sampling.
Gikandi who is a retired DCI officer produced the report indicating that the DNA samples collected from the body of Yogesh Madan Sapra matched with those collected from the carpet and bedsheets from their bedroom.
He also presented a report from Nairobi Hospital indicating that Yogesh succumbed to stab wounds in the stomach and on the armpit.
“The medical report showed that Yogesh died of stab wounds allegedly inflicted by his wife,” Gikandi told the court.
State prosecutor Willy Momanyi leading evidence asked the retired police officer, who could have stabbed the deceased?
“The only person who could have stabbed Yogesh is his wife who is sitted in the dock,” the officer responded.
Her son Rishi Sapra told police that is her mother who stabbed his dad on their bedroom.
Rishi’s bedroom, the court heard it was adjacent to their parent’s.
Rishi who resides in Canada will testify against the mother in a month’s time and will tell how the incident occurred.
The court heard that the son is going psychological treatment in Canada and the prosecutor said that his testimony will be conducted via video conference as directed by the court in May 2023.
Cross examined by lawyer Kioko Kilukumi, Gikandi admitted not to investigate the Nairobi Hospital for the 17 days on how it managed the deceased,
“This is a case of medical negligence and the doctor who was handling the deceased is under investigation,” Kilukumi said.
The lawyer inquired from the prosecution whether the doctor who was handling the deceased will testify since he is accused of negligence.
According the postmortem report by pathologist Dr Jane Wasike and another indicated that Yogesh died of bacteria infection in the blood (Septicemia).
After the investigations, Mr Gikandi said an inquest in to the death was conducted and a former senior resident magistrate Timothy Okelo recommend Nisha be charged with murder which reduced later to manslaughter but Justice retired Muga Apondi.
Nisha had denied to kill her husband and is out on bond.
