EACC granted warrant to search Nyamira governor Amos Nyaribo’s properties in Ksh 20 Million graft probe

by Faith Karanja

A Nairobi court has granted the Ethics and Anti-Corruption Commission (EACC) authority to search the properties of Nyamira Governor Amos Nyaribo over a KSh 20 million graft investigation.

The Milimani Chief Magistrate’s Court issued the warrant allowing EACC officers to search the governor’s homes and offices for documents and electronic devices linked to the probe.

The investigation forms part of the ongoing Amos Nyaribo graft probe involving alleged economic crimes and irregular payments.

EACC targets governor’s homes and offices

The court authorised EACC investigators to search Governor Nyaribo’s Karen residence and other properties linked to him across Kenya.

The warrant allows investigators to collect electronic devices, financial documents, title deeds, and other records that may support the investigation.

EACC investigator Evans Gitonga requested the orders, stating that the documents could help establish whether public funds were misused.

The court issued the warrant under Miscellaneous Criminal Application No. E/4-69 of 2025.

Investigation focuses on KSh 13 million housing allowances

Court documents show that EACC is investigating alleged irregular housing allowance payments made to Governor Nyaribo.

The commission claims Nyamira County officials paid the governor housing allowances amounting to KSh 13 million between the 2017/18 and 2021/22 financial years.

EACC told the court that the payments may have violated public finance regulations.

The commission also launched investigations into alleged irregular ex-gratia claims worth KSh 5 million.

According to EACC, the county paid the claims despite covering the governor’s medical expenses.

EACC probes procurement irregularities

The anti-corruption agency is also investigating alleged procurement irregularities within the Nyamira County Government.

The probe includes claims of unlawful contract extensions and payments for incomplete projects.

EACC told the court that investigators needed access to records and electronic devices to verify the allegations.

The commission argued that a surprise search would prevent possible interference with evidence.

Court allows immediate search operation

The court allowed EACC officers to conduct the searches between 6:00 am and 6:00 pm.

The warrant also permits officers to use reasonable force if they face resistance while executing the order.

The magistrate waived the requirement for additional court endorsement outside Nairobi.

This allows EACC officers to search other properties linked to the governor in different parts of the country.

EACC promises proper handling of evidence

EACC assured the court that officers would handle all seized materials responsibly.

The commission said it would preserve any documents or devices collected during the operation.

EACC also committed to preparing an inventory of all seized items and providing a copy to Governor Nyaribo.

Probe continues

The court scheduled a follow-up mention where EACC will provide an update on the investigation.

The case places Governor Nyaribo under scrutiny as investigators continue examining allegations of economic crimes and misuse of public funds.
