Omtatah Challenges EACC’S Internal recruitment process.

Human Rights Activist Okiya Omatatah filed a petition challenging the constitutional and legal validity of EACC’s decision to fill senior management   vacancies in its secretariat through an internal recruitment process, which is restricted to its existing workforce and, therefore, is discriminatory to the extent that it excludes outsiders who are eligible/qualified and interested to compete for the jobs.

On Friday, 28.08.2020, the Hon. Mr. Justice Byram Ongaya, a Judge of the Employment and Labour Relations Court at Nairobi, issued the following orders in the matter.

“The notice of motion is certified urgent for hearing during the current court recess to be served today for inter parts hearing or further orders and directions on Wednesday 02.09.2020 as will be listed and called out before the Hon. Recess Duty Judge.
