Court has stopped the newly elected officials of the FKF Garissa North East Sub-branch elections held on September 26,2020 from assuming office pending the hearing and determination of this application.
Senior Resident Magistrate Ole Tanchu who issued the orders directed the application dated September 28,2020 t be served for all the parties hearing on October 7,2020.
Through lawyer Suleiman Bashir, Football Kenya Federation (FKF)Electoral North East South Branch Vice-Chair Hassan Abdi says that FKF Board Contemnor has violated the court order by refusing to comply with the dictates of the said order and thus conducting the FKF Garissa North East South Branch on September 26,2020.
“By a ruling of the court on September 24,2020, FKF’S board contemnor was prohibited from conducting the elections that were scheduled on September 26,2020 pending the hearing and determination of the application in court,” said Suleiman.
He continued that FKF election board’s conduct and willful disobedience and defiance of the court order has brought into the court ridicule and great disrepute to prejudice against him.
Lawyer Suleiman wanted the court to punish the members of FKF board who are Kentice Kitolo (Chairperson), Patrick Onyango (Secretary) and three other members for contempt of court orders issued on September 24,2020.
The orders had prohibited the officials from conducting the Garissa FKF North East South Branch elections on September 26,2020.
“We want the court to issue warrants of arrest against the said officials for committal to jail for a period of 6 months or as the court may direct pending the furnishing of security,” added lawyer Suleiman.
Lawyer Suleiman wanted the court to order the officials to deposit their passports in court before the security.
“We also want the court to stop the newly elected officials of the FKF Garissa North South Branch elections held on September 26,2020 from assuming office pending the hearing and determination of this matter, “said Suleiman.
It was contested that out of 28 teams which are eligible to vote in that area 10 of them do not play within Garissa County thus are not eligible to participate in the elections.
