A senior KRA employee will on Friday be sentenced after the court found him guilty and convicted him of obtaining over Sh 7.8 million by falsely pretending that his Law firm was authorized to collect taxes.
Milimani senior principal magistrate Bernard Ochoi ruled that the accused Peter Muhu Muriuki, did not dispute the allegations that he was a KRA officer and that he misled scripture mission east Africa by stating that his law firm was entitled to collect Taxes.
He said that there is evidence that Muriuki induced Director Scripture Mission East Africa to deliver Sh 7.8 million to an account belonging to Mungu and Co-advocates by falsely pretending the said Law firm was an agent of KRA and authorized to collect taxes.
Muriuki is also charged with uttering a fake Kenya Revenue Authority pay as you earn credit slip to the director, scripture mission east Africa purporting it to be valid.
The magistrate said that at the closure of the prosecution case, the prosecution called a total of 12 witnesses all of which successfully identified the accused person.
“The court has satisfied that the prosecution had proved their case beyond reasonable doubt and I therefore find him guilty and convict him as charged,’ said the magistrate.
The prosecution informed the court to treat Muriuki as a first offender since they had no previous criminal records against him.
The case will be mentioned on Friday for mitigation and sentencing.
