Speaking outside Milimani Law Courts, Omari said the defence team’s role was to represent anyone who seeks legal assistance, while also expressing condolences to Ojwang’s family.
He added that Talaam had also sent his condolences following Ojwang’s death.
Omari defends Talaam’s actions
Omari stated that Talaam was not arrested in Eldoret as alleged.
According to the lawyer, Talaam presented himself to the Directorate of Criminal Investigations (DCI), which later took his statement at the Independent Policing Oversight Authority (IPOA).
He also said Talaam properly handed over Central Police Station to his deputy before leaving, including official items such as the office and station communication equipment.
The lawyer said the defence team would rely on an alibi defence during the case.
Defence calls for fair investigations
Omari acknowledged that IPOA confirmed Ojwang died while in police custody.
However, he argued that the circumstances surrounding the death require a proper legal process and not public pressure.
He dismissed claims that a police officer impersonated another person, terming the allegations misleading.
The lawyer warned against targeting Talaam because of his ethnic background, saying no person should be sacrificed due to their community.
Lawyer questions public pressure
Omari criticised what he described as pressure from sections of the public demanding quick action before investigations are complete.
He compared the situation to mob justice and insisted that the truth can only emerge through proper investigations and an inquest.
The lawyer also said the police chain of command should be considered when examining the actions of officers.
He explained that instructions from senior officers normally pass through various levels before reaching an OCS.
Omari insists on due process
The defence lawyer maintained that the matter should follow the law and that all parties deserve a fair hearing.
He said political interests should not interfere with justice, adding that the defence team would continue representing Talaam and any other person seeking legal assistance.
Omari confirmed that three civilians had been arrested in connection with the matter.
He maintained that Talaam had no involvement in the alleged actions and that the court process would determine the facts.
