Nelson Ndalila plea-taking deferred
Ndalila did not appear before Milimani Magistrate Dolphina Alego on Friday. The magistrate directed him to appear in court on Tuesday, May 5.
However, lawyer Andrew Muge opposed the request to defer the plea on medical grounds. Muge is watching brief for the complainant.
“The accused was arrested yesterday (Thursday) and was expected in court today. His not being in court today is a clear indication of delaying tactics,” Muge said.
Ndalila faces four counts, including forgery. Meanwhile, he remains out on police cash bail of Ksh50,000.
Lawyer accused of forgery to obtain Sh59M
According to the main count, prosecutors allege that Ndalila acted jointly with other people who are not before the court.
The alleged offence occurred on June 2, 2023, at an unknown location in Kenya. Prosecutors allege that Ndalila intended to defraud others.
They claim he made a document known as the Trust Deed for Better Life Family Trust. The document bears the date June 2, 2023.
Prosecutors allege that the document purported to be a genuine trust deed for properties belonging to the late David Jonathan Grantham. They further claim that Ndalila knew the document was false.
Sh59M sought from late David Jonathan Grantham’s estate
In the fourth count, prosecutors allege that Ndalila and others forged a trust deed in the name of Better Life Family Trust.
The alleged trust deed also bears the date June 2, 2023. Prosecutors claim the accused intended to use the document to obtain financial benefits from the estate of the late David Jonathan Grantham.
The alleged financial benefit amounts to Ksh59 million.
