Three face fraud charges
The prosecution alleges that, between April 29, 2023, and May 5, 2023, in Nairobi, the three accused jointly acted with others who are not before the court.
According to the charge sheet, they intended to defraud Abdi Edin Mohammed of Sh2.6 million by using fraudulent tricks.
Prosecutors claim the suspects displayed and handed over a wrapped black envelope purportedly containing genuine gold nuggets.
Second count relates to obtaining money by false pretences
The three accused also face a second count of obtaining money by false pretences.
The prosecution alleges that, during the same period, they obtained Sh2.6 million from Abdi Edin Mohammed by falsely claiming they had genuine gold for sale.
The prosecution maintains that the representation was false.
Complainant recounts transaction in court
While testifying, Abdi Edin Mohammed told the court that he withdrew KSh2 million from his Equity Bank account.
He said he later handed over the money after meeting Mohamed Hassan in Eastleigh.
The complainant also told the court that he had earlier received a phone call from a person using a foreign telephone number.
Package allegedly contained salt
Mohammed testified that the alleged gold consignment reached him on April 2, 2023.
However, he waited until April 5 to open the sealed package.
When he finally opened it, he discovered that it contained salt instead of gold.
The complainant, who is also the director of a registered company, later identified two of the suspects at Muthaiga Police Station.
However, he confirmed that he was not present when police arrested them.
Arrest and next court date
Police arrested the suspects on October 20, 2023.
Authorities presented them before court on October 23, 2023, where they remained in custody pending further proceedings.
The charge sheet further indicates that police arrested the suspects without a warrant.
The prosecution has listed Abdi Edin Mohammed as one of its witnesses.
Investigators continue to gather evidence, and the prosecution expects to present more evidence during the trial.
The court adjourned the matter to July 21 for further hearing.
