Court threatens to arrest IO in Sh 356M case for playing games with it.

A Nairobi court has threatened to arrest an Investigating Officer (IO) over delays in a case where a former director faces charges involving Sh356 million.

Milimani Trial Magistrate Dolphina Alego warned the officer after he failed for the second time to provide documentary evidence required for the case to proceed.

Magistrate criticises delays in fraud case

The fraud case against former director Honey Khatwani came up for mention at Milimani Law Courts.

During the session, the prosecution requested more time to supply documentary evidence to the defence.

However, Magistrate Alego declined the request and blamed the Investigating Officer for delaying the proceedings.

She warned the officer against interfering with the progress of the case.

The magistrate said such delays could create the impression that the accused and investigators were working together to frustrate the matter.

Court gives DPP final chance to provide documents

Alego gave the Director of Public Prosecutions (DPP) a final opportunity to provide the required documents and materials to the accused.

The prosecution requested one more week to complete the process.

However, the defence opposed the request, arguing that the delay had affected the accused and that the matter should proceed without further interruption.

Hearing date set after agreement

Following discussions between the defence and prosecution teams, the court directed the parties to conduct the pre-trial process on July 10, 2025.

The court also directed the prosecution to supply the documents to the defence on the same day.

Khatwani faces Sh356M theft charges

According to the charge sheet, Khatwani allegedly stole Sh356 million between January 1, 2020, and June 30, 2024.

The prosecution alleges that the funds came into his possession because of his position as a director.

Khatwani is accused of committing the offence at Baba Dogo in Nairobi County.

The accused is out on a cash bail of KSh5 million or an alternative bond of KSh10 million.

Complainants raise concerns over case delays

The complainants claim that the case faces unnecessary delays.

They allege that some businessmen and investigators could be frustrating the proceedings.

The accused is also alleged to have threatened witnesses, claims that remain part of the ongoing case.

Magistrate Alego warned that if the Investigating Officer does not want to prosecute the matter, the accused should be released and the complainants allowed to pursue their legal options.
