Solheim held a press briefing outside the Milimani Law Courts, where he explained his efforts to recover the funds.
He claims that he deposited money into Dennis Onyango & Associates accounts after being involved in a proposed gold business transaction.
Norway national claims he deposited Sh52 million
According to Solheim, he made several deposits from his personal bank account in Norway into Dennis Onyango & Associates accounts.
The deposits were made on August 18, 2023, October 2, 2023, November 13, 2023, and December 8, 2023.
The total amount deposited was USD 403,097.
Solheim claims that after depositing the money, he never contacted the respondent or gave any authority regarding the expenditure of the funds.
He says the proposed purpose for which the funds were deposited did not materialise and is no longer required.
“I have asked the respondent to return my monies back since there is no further reason for the respondent to hold on to these funds for me, nor does there exist any legal basis for the respondent to retain the funds,” he said.
Lawyer accused of failing to refund money
Through his lawyers Felix Keaton Kiprono, Vincent Yegon, and Abdirizack, Solheim says the matter filed at the Milimani Commercial Division has been pending for over a year.
Lawyer Yegon accused Onyango of failing, refusing, and neglecting to return the funds.
The lawyers expressed concern that Onyango may have used the money without their client’s authority.
They said this could affect Solheim’s business and cause him significant financial losses.
“The said monies are allegedly held in the accounts of the respondents at Stanbic Bank Kenya at Chiromo branch,” Yegon said.
Allegations of false documents raised
Lawyers representing Solheim have also accused Onyango of presenting false documents to their client.
They claim Onyango forged a document allegedly from Barclays Bank.
According to Keaton, the bank denied the claims contained in the document.
Solheim says he has continued to suffer financial losses due to the failure to refund his money.
Court asked to freeze account and provide statements
Solheim has asked the court to compel Barclays Bank to provide account statements pending the hearing and determination of the application.
He also wants the court to freeze the account and stop any utilisation or transfer of the money.
The Norway national wants the court to protect the funds until the dispute is resolved.
Solheim seeks recovery of USD 403,097
Solheim maintains that he deposited the money for a gold business arrangement.
He says he has never authorised the use of the funds because the proposed transaction did not materialise.
He is seeking the return of USD 403,097 from the respondent.
The matter remains before the Milimani Commercial Court, where the court will determine the next steps.
