When the case against Abdirahman Muhumed Abdi alias Abdi appeared before Magistrate Geoffrey Onsarigo, the prosecution informed the court that the DPP wants to withdraw the case.
The complainant strongly opposed the move. He said he was not aware of any attempt by the parties to withdraw the case.
Muhumed charged with forgery and making a false document
In the case, the prosecution charged Muhumed with forgery and making a false document contrary to the law.
The prosecution alleges that Muhumed attempted to defraud PANSIBA Limited of two parcels of land.
The parcels, LR No. 209/10848 and LR No. 209/10849, measure approximately 0.8000 hectares and are valued at Sh300 million.
The prosecution alleges that Muhumed fraudulently amalgamated the two parcels, creating LR No. 209/16790.
He allegedly forged a certificate of title for the parcel of land and presented it as a genuine Certificate of Title issued by the Ministry of Lands and Physical Planning, despite knowing it was false.
Accused linked to forged title deed allegations
The prosecution charged Muhumed in the second count with forging the title deed and amalgamating the two parcels of land.
The amalgamation resulted in LR No. 209/16791.
The prosecution also alleges that Muhumed made a provisional approval dated April 4, 2006, from the Ministry of Lands.
He allegedly presented the document as a genuine Certificate of Title issued by the Ministry of Lands and Physical Planning, knowing it was not true.
Muhumed accused of making false document
The prosecution charged Muhumed in the last count with making a false document contrary to the law.
The court heard that Muhumed allegedly made a document known as P.P.A 2 issued by the City County of Nairobi.
The prosecution alleges that he made the document with the intention of defrauding PANSIBA Limited of his land, knowing the information contained in it was false.
Accused denies charges
Muhumed denied all the charges after taking plea.
He remains out on bail as the case continues.
