Joshua Kimaita Kirera appeared before Milimani Magistrate Dolphinah Alego, where he denied seven charges, including allegations of forgery.
Contractor denies land fraud charges
Kimaita pleaded not guilty to accusations that he conspired with others to defraud Pinnacle Business School Limited of its land.
According to the charge sheet, the disputed property is identified as land parcel Kajiado/NTASHART/1583, measuring approximately 8.611 hectares and valued at Sh200 million.
The prosecution alleges that fraudulent documents were used in a Kajiado Environment and Land Court matter, which resulted in orders directing the land registrar in Ngong to issue a title deed in favour of Super Drill International Limited.
The alleged offence occurred on or before February 28, 2023, within the Republic of Kenya.
Prosecution seeks suitable bail terms
The Director of Public Prosecutions did not oppose Kimaita’s release on bond or cash bail.
However, the prosecution asked the court to consider the seriousness of the allegations when setting the bail terms.
“Even though the offence is bailable and we are not opposing it, we are asking this court to issue bond or cash bail that is commensurate with the offence,” the DPP told the court.
Defence cites medical condition
Kimaita’s lawyer asked the court to release him on bond or cash bail, stating that he had presented himself before the court.
The defence also submitted medical documents showing that Kimaita had been unwell.
The documents were presented to explain why he failed to appear during previous mentions for plea taking.
Court orders pre-bail report
Magistrate Dolphinah Alego directed that a pre-bail report be prepared before determining the bond terms.
The court will consider the report before issuing further directions on Kimaita’s release.
Second accused fails to appear
The court extended a warrant of arrest against the second accused person, David Omondi Opondo.
Opondo failed to appear in court for plea taking for the third consecutive time.
Case to continue in September
Kimaita also denied other charges relating to forgery.
The matter will be mentioned on September 15, 2025, for directions on bond terms.
