A Nairobi businessman has been charged in KSh200,000,000 million land fraud

A Nairobi businessman, Joshua Kimaita Kirera, has been charged over an alleged KSh200 million land fraud involving the disputed ownership of a property belonging to Pinnacle Business School Limited.

Kimaita appeared before Milimani Magistrate Dolphinah Alego, where he denied seven charges, including allegations of forging documents and conspiracy to defraud.

Businessman denies land fraud charges

The prosecution accused Kimaita of involvement in a scheme to fraudulently acquire a parcel of land measuring approximately 8.611 hectares in Kajiado County.

According to the charge sheet, the property identified as Kajiado/NTASHART/1583 is valued at KSh200 million.

The prosecution alleges that Kimaita, together with others not before court, used fraudulent documents in a Kajiado Environment and Land Court matter to obtain orders that led to the issuance of a title deed in favour of Super Drill International Limited.

The alleged offences are said to have occurred on or before February 28, 2023, at an unknown location within Kenya.

Prosecution seeks suitable bail terms

The Director of Public Prosecutions (DPP) did not oppose Kimaita’s release on bond or cash bail.

However, the prosecution asked the court to consider the seriousness of the allegations when setting bail terms.

The DPP urged the court to impose conditions that would be appropriate considering the nature of the offence.

Defence cites medical condition

Kimaita’s lawyer asked the court to release him on bond or cash bail, informing the magistrate that he had voluntarily appeared before court.

The defence also presented medical documents explaining that Kimaita had been unwell, which affected his ability to attend previous court appearances for plea taking.

Court orders pre-bail report

Magistrate Dolphinah Alego directed that a pre-bail report be prepared before determining the bond terms.

The court will rely on the report before issuing further directions on Kimaita’s release conditions.

Second accused remains absent

The court also extended a warrant of arrest against the second accused person, David Omondi Opondo.

Opondo failed to appear in court for plea taking for the third consecutive time.

Case to proceed in September

Kimaita pleaded not guilty to the charges, including the alleged forgery offences.

The matter will be mentioned on September 15, 2025, for further directions on bond terms.
