The High Court has fixed September 17, 2026, for the hearing of a judicial review application filed by activist Francis Awino challenging ongoing road and pedestrian infrastructure works in Nairobi’s Central Business District after declining to certify the matter as urgent.
Justice Dr. Nabil Mokaya Orina directed that the case proceed through the normal inter partes process, allowing all parties an opportunity to file their responses before the court considers the application for leave and stay orders.
The court ordered Awino to serve the respondents within seven days, after which the respondents will have 21 days to file their responses. The matter will then be mentioned for hearing on September 17, 2026.
Awino’s application challenges the implementation of ongoing cabro paving, pedestrian walkways and non-motorised transport infrastructure works on several roads within Nairobi’s CBD, including Haile Selassie Avenue, Moi Avenue, Taifa Lane, the Kencom area and adjoining streets. He is seeking judicial review orders questioning the legality of the project and the decisions authorising its implementation.
In the directions issued by the court, Justice Orina stated that “the matter is not certified urgent” and ordered that the application for leave and stay be heard inter partes before any further orders can be considered.
