Neslon Havi has moved to court and filed a petition challenging the new Competency Based Curriculum (CBC).
In his application he says that the education system in Kenya should not be an expensive affair or an ineffective experiment on school going children.
He says that the petition raises substantial and novel questions requiring consideration by an uneven number of judges, being not less than five to be assigned by the Chief Justice.
The actions of the Cabinet Secretary Responsible for Matters Relating to Basic Education, Basic Education, Kenya National Examinations Council and Teachers Service Commission as set out in the petition are manifestly unconstitutional and unlawful, and prejudicial to the future of the children of Kenya and ought to be halted pending the determination of the questions raised in the petition.
“It is just and proper that notice of motion be certified urgent and orders sought be granted pending the hearing of the petition to prevent a further denial, violation or infringement of the rights of children to education and free and compulsory basic education by the education officials, “he added.
