Through PW Wena & Company Advocates, Miller has demanded that Amenya removes the publication, issues an apology, and compensates him for the alleged harm caused.
Miller challenges KUSCCO publication
Miller says Amenya published a defamatory article titled “Update: Vipindire at KUSCCO” on August 12, 2025.
According to Miller, the article contained false claims about Miller & Company Advocates and its role in handling KUSCCO matters.
He argues that the publication created a negative impression about his professional conduct and damaged his reputation among clients, colleagues, and the public.
Lawyer demands removal and apology
In the demand letter, Miller’s lawyers gave Amenya twelve hours to remove the article from his X account and other social media platforms.
They warned that they would file a lawsuit if he failed to comply within the given period.
Additionally, the lawyers demanded an unconditional apology that Amenya would publish on his X account.
“We demand that you immediately tender an unequivocal and unconditional apology to our client and publish the said apology in terms acceptable to our client,” lawyer Wena stated.
The legal team also asked Amenya to propose compensation for the alleged damage caused to Miller’s reputation.
Disputed remarks on KUSCCO legal fees
The dispute arose from remarks in Amenya’s article about KUSCCO’s financial affairs.
The article claimed that Miller & Company Advocates had received more than Sh30 million for representing KUSCCO in what Amenya described as questionable cases.
It also questioned additional consultancy expenses linked to the organisation.
However, Miller disputes the claims and says the remarks falsely suggested that his firm received money through dishonest means.
Miller says allegations harmed his reputation
Miller’s lawyers argue that the statements portrayed him as dishonest and accused him of receiving millions of shillings for work that did not exist.
They say the allegations exposed him to public ridicule, suspicion, and contempt.
Furthermore, the lawyers maintain that Miller has built his career on professionalism and integrity.
They argue that unverified accusations can seriously affect the reputation of legal professionals.
Defamation dispute heads toward possible court battle
The dispute highlights the growing tension between freedom of expression and protection of reputation in Kenya’s digital space.
On one hand, public commentary plays an important role in discussing issues affecting institutions such as KUSCCO.
On the other hand, individuals must support serious allegations with evidence to avoid defamation claims.
For now, Amenya has not publicly responded to Miller’s demand.
If the matter remains unresolved, Miller’s legal team says it will proceed with court action to protect his reputation.
