A 70 year old man has been sentenced to 20 years in prison after a court in Loitoktok, Kajiado County, found him guilty of defiling a minor.
In a judgment delivered by Principal Magistrate Gachuki Nelson, the court convicted the accused of defilement contrary to Section 8(1) of the Sexual Offences Act over an incident that occurred on January 11, 2026.
During the trial, Principal Prosecution Counsel Thomas Mwaura told the court that the victim had gone to a nearby market to buy water before the accused allegedly lured her into his house, where the offence was committed.
According to the prosecution, the victim’s father rushed to the scene after receiving information from a concerned neighbour and found the accused in the act, leading to his immediate arrest.
In its decision, the court held that the prosecution had proved the case beyond reasonable doubt after establishing the victim’s age, proving penetration and positively identifying the accused through witness testimony supported by medical evidence.
Although the defence urged the court to consider the accused’s advanced age and previous good character during mitigation, the magistrate upheld the 20 year custodial sentence, noting that the law prescribes a mandatory minimum punishment for the offence.
