Court stops Publications of defamatory Articles against Urithi Housing Co-operative Society.

A Nairobi Court has restrained Nation Media Group and a blogger from publishing alleged defamatory Articles against Urithi Housing Co-operative Society Limited.

Lady Justice Lucy Njuguna issued the orders after Urithi Housing filed the suit under certificate of urgency.

“I restrain Nation Media group and blogger identified as Susan Wanja alias ‘Freedom because of brave (Urithi scam)’, from writing, printing and publishing or broadcasting defamatory statements about the Sacco and its directors and members,” ordered Njuguna.

The orders were issued on July 22,2020.

Urithi through its Chairman Samuel Maina contests that Wanja using pseudo name had published untrue and defamatory articles at Urithi scams group and Kenya insights against his company.

Maina also accuses Nation Media of perpetuating the same sentiments where it published articles on July 6,2020 claiming “they had sold air to unsuspecting Kenyans killing their dreams to become homeowners…”

But in attached court documents, Maina indicate they have successfully completed and handed over 59 projects to their members and have 30 projects under title processing stage while 45 are under constructions.

Maina adds that Wanja has defamed him and his company on facebook and other online platforms blatantly and openly discouraging members of the public from investing with Urithi housing cooperative company.

“That a temporary injunction be issued to retrain Wanja and Nation media group from further authorizing, writing and publishing any articles, comments that are libelous or injurious falsehood pending hearing and determination of the suit”, the documents filed by Mwenda Njagi & Co. Advocates reads

He claims the defamatory articles at Urithi scam group were published between July 1 and 10, 2020 and has been repeating thereafter.

The businessman says that the allegations contained in the article had a clear intention to scandalize, defame and injure his reputation and ridicule with aim of causing damage and injury to his reputation in general.

Maina also wants the Directorate of criminal investigations be and directed to assist in unravelling the identities of Wanja who has portrayed Maina as a person of loose morals and a fraudster who cannot be trusted with public funds and office.

Consequently, Maina says in court documents that the publication of confidential reports purportedly from Wanja which was unverified and suspected to be stolen information continues to endanger him and his family especially his children and exposing him to physical and irreparable economic harm.
