Former Tetu MP Ndung’u Gethenji’s Assault case pushed to February next year.

Gethenji is alleged to have assaulted Godfrey Mutua at Kihingo village in Kitisuru.

An assault case against Ex-Tetu MP James Gethinji has been pushed to February 5, 2024.
When the parties appeared in court today, the court was informed that the remaining three witnesses could not testfy today.
The prosecution said that a Doctor who was to testify today can only testify on Tuesdays.
Gethenji is alleged to have assaulted Godfrey Mutua at Kihingo village in Kitisuru, Westland’s Sub-County on February 5, 2021 causing him actual bodily harm.
When the matter had earlier been mention before magistrate Muthoni Nzibe of Milimani Law Courts, the court was informed that the prosecution had amended the charge sheet and Gethenji should plead to new charges.
The new charge sheet indicated assault causing actual bodily harm contrary to section 251 of the penal code.
It stated that on February 5, 2021 at Kihingo village in Kitisuru, Westlands, Nairobi, he assaulted Mutua thereby occasioning him bodily harm.
Through his lawyers Willis Otieno and Ishmael Nyaribo, Getheni opposed to the adjournment saying that the prosecution is delaying the case since there had been numerous adjournments.
“Court must be respected otherwise this trial becomes a misconception of justice, “added Nyaribo.
They added that there is no need of a forensic witness while this is just an assault case saying that the witness who was to testify today is new to them.
The court was informed that only three witnesses are remaining for the prosecution to close its case.
The matter will be mentioned on February 5, 2024.
