Court suspends probe against Nairobi Hospital.

The  High  court in Nairobi has suspended  investigations against Nairobi Hospital, pending the hearing and determination of a petition filed by the hospital’s board of directors.

Judge John Chigiti issued orders stopping DCI from conducting the probe, which started last Friday with the raid at the premier facility.

The orders were issued after the management complained that the DCI officers had taken away documents and equipment containing sensitive patients’ data, raising serious concerns of potential compromise of patient confidentiality and a possible breach of the right privacy.
Justice John Chigiti also halted a move by the investigative agencies to block or freeze the phone numbers and bank accounts belonging to the hospital’s senior Management.

The legal team representing a faction of hospital’s board, Danstan Omari, Cliff Ombeta, Shadrack Wambui, and Samson Nyaberi, held a press briefing in which they accused the Attorney General’s office of overstepping its role.

According to lawyer Omari, the Attorney General’s office should only serve in an advisory capacity on legal matters and not interfere with board appointments or recommend criminal charges against current members.

 

Justice Chigiti directed the case to be mentioned on April 7.

The hospital said in a statement that the DCI officers carted away sensitive documents, raising serious concerns of a possible breach of the right to privacy.
