Ringtone denies Sh50M land fraud charges
Ringtone faces charges alongside Juma Alfred Ayora over allegations that they defrauded businesswoman Terresia Adhiambo of a piece of land valued at KSh50 million in Karen.
Ayora had already taken plea in March, but Ringtone failed to appear for plea taking.
Following his failure to attend court, the magistrate issued two warrants of arrest against him.
Singer accused of conspiracy to defraud
The prosecution alleges that on or before February 28, 2023, at an unknown location within Kenya, Ringtone and Ayora conspired to defraud Terresia Adhiambo Odhiambo of land parcel number NAIROBI/BLOCK 99/142.
The property measures approximately 0.1908 hectares.
According to the charge sheet, the two allegedly claimed adverse possession based on residency for more than two decades in an attempt to gain control of the land.
The prosecution says the accused made the claim without following the required legal procedures, leading to the conspiracy to defraud charge.
Ringtone accused of forgery and perjury
The two also face charges of forgery and perjury.
They are accused of falsely swearing an affidavit before advocate S.M. Katonya on February 28, 2023, in Nairobi.
The affidavit allegedly stated that Apoko had lived on the property for 20 years, a claim the prosecution says was false.
The prosecution told the court that the affidavit formed part of a plan to unlawfully acquire the land through misleading documents.
Court denies singer bail pending report
Senior Principal Magistrate Dolphina Alego denied Apoko bail until Monday, when the court will rule on his bail application.
The court will receive a pre-bail report on Monday before making further directions.
Ringtone remains in custody as investigations continue.
The case has attracted public attention due to the involvement of the well-known musician and the high value of the disputed land.
