The auction follows a ruling issued by the Milimani Commercial Court on August 15, 2025, directing police officers to supervise the distress for rent process.
Court orders police supervision of auction
Senior Principal Magistrate Lucy Njora issued the orders in a case involving Galaxy Middle East & Africa Limited, trading as Smart Pro, and Oki General Trading Ltd.
The case was filed under MCCCMISC/E2036/2025, with Zachary Baraza Siuma Auctioneers handling the distress for rent proceedings.
The landlords moved to court seeking recovery of rent arrears, claiming that the unpaid amounts affected their operations.
The court directed the OCS Parklands Police Station and OCS Ruaraka Police Station to supervise the auctioneer during the process.
Court clarifies auction order
Magistrate Njora clarified that the order only allowed the auctioneer to recover rent arrears.
She stated that the directive did not permit eviction or demolition of the premises.
The court warned that anyone who disobeys the order could face legal consequences.
Rent dispute involving Galaxy Middle East & Africa
The dispute involves Galaxy Middle East & Africa Limited and its directors, including Honey Khatwani.
The landlords accused the company of failing to meet rental obligations.
They asked the court to allow the distress for rent process to recover the outstanding amount.
The company, however, has been involved in a separate criminal case where Khatwani faces charges related to alleged theft of Sh356 million from Oki Trading Kenya Limited.
Khatwani faces Sh356 million fraud charges
In the criminal case, Khatwani is accused of stealing approximately Sh356 million belonging to Oki Trading Kenya Limited.
The prosecution alleges that the money came into his possession through his position as a company director.
Khatwani has denied the allegations and is currently facing trial.
The case alleges that he used the funds to establish Galaxy Middle East Africa Limited, a company operating in a similar business sector.
Court dispute continues
The auction has increased attention around the businessman, who is facing both commercial and criminal proceedings.
The court will continue handling the separate matters as parties pursue their legal claims.
