Four people accused of defrauding Fina and Eco bank 96 Million have been put on their defense.
The four Graham Rioba Sagwe, Obadia Nyambane Gwaro, Gladys Moraa Gichana and Robert Moseti Onkwani are facing four counts of stealing and conspiracy to steal.
 They are accused that on November 12, 2010, at an unknown place within the country, conspired together to defraud Fina Bank Sh 96,759,540.
In the second count, Graham was charged with stealing Sh96, 759,540 from the Fina Bank on November 15, 2010.He is said to have defrauded Fina Bank Ngong Road Branch.
On the third count, Rioba and Moraa were charged on November 15, 2010, at EcoBank Eco bank Towers Branch in Nairobi within the country, jointly with others not before the court stole Sh 96,759,540 the property of the bank.
On the last count, Moseti was charged that on November 15, 2010 at Barclays Bank-Development House Branch in Nairobi, stole Sh 10million the property of Fina Bank Limited.
When the matter came for hearing today, lawyer Danstan Omari who is acting for Nyambane and Moraa said they are in the process of settling the matter out of court.
“My clients who have put on their defense are trying to find solutions but paying what is due to the complainants, “added lawyer Omari.
Omari told magistrate Francis Andayi that they are having communication with the Director of Public Prosecution on the issue but today he was travelling.
“We did not conclude the talk on Friday last week and we have scheduled another meeting on 4thof next month with the view of agreeing the way forward,” he added.
He told magistrate Andayi that if they agree, it will be in the interest of saving judicial time.
The prosecution said that indeed she has been informed that the accused wants to settle that matter out of court and that they are in the process of negotiation.
Moseti was not in court today as he was said to be unwell.
The matter will continue on September 29, 2021.
