Court stops Communication Authority from carrying out interviews and recruitment of some of its employees pending the hearing of the matter.

A High Court in Nairobi has stopped Communications Authority (CA) from carrying out interviews and recruitment of some of its employees pending the hearing of the matter.

 Justice Monica Mbaru issued issued orders stopping Communications Authority (CA) from carrying out interviews and recruitment of some of its employees pending the hearing of the matter.

Through Lawyer Henry Kurauka,  the Petitioner,  Antony Muchui Manyara pleaded that the CA contravened the constitution by usurping the powers of PSC in respect of HR instruments which weren’t not donated to them by PSC as required by the constitution.

Lawyer Ms Jacqueline Manani representing PSC confirmed supported issuance of conservatory orders and stated that State Corporations Advisory Committee (SCAC) and Communications Authority (CA) have no authority to issue HR instruments because constitution provides that it is only PSC that has such powers.

All the Parties were directed to file written submissions for directions on December 2, 2021.
