A lawyer has been charged with forgery at Milimani Law Courts.
Dennis Kamau Kariuki appeared before Milimani Senior Principle Magistrate Geoffrey Onsarigo and denied the charges.
He was charged that on diverse dates between September 23,2024 and September 6,2024,with intent to deceive and against the law,he made a court order MCCRMISC/E3074/2024,purporting it to be a genuine court order issued by Miliyvmani Chief Magistrate’s Court.
He was charged in the second count with uttering a false document contrary to section 353 of the penal code.
The lawyer was charged that on September 6,2024 within the coutry,he uttered a forged court order purporting it to be a genuine court order issued by Milimani Chief Magistrate’s court.
On September 23,2024 the court had postponed his plea taking to allow him undergo a medical examination.
“Our client is suffering from depression following the death of his mother a month ago and needed medical attention,”added defense team.
They requested for two weeks defferal of the plea till today.
The prosecution today dismissed their request for differal saying that the conduct of the accused has not indicated any mental incapacity.
“The accused has cooperated well with the investigation officers which is an indication that he is mentally fine,”added prosecuter.
They added that mental assesment can be conducted later since now the accused has pleaded to the charges.
It is said that the accused had been practising law for four years and had never been charged before a court.
They had tried to argue that he has no previous criminal records and urged the court to admit him with personal bond due to the issue of mental illness.
He had also tried to block the media from covering him but the court ruled that there was no substantial evidense presented in court to justify the courts order for a closed trial.
“I release the accused on Sh 1M bond or a cash bail of Sh 200,000 with two sureties,”Ruled Onsarigo.
Today he was released on a Bond of Sh 1M or a Cash bail of Sh 200,000 similar terms with the other once.
