Former LSK president Nelson Havi stopped from Defaming Lawyer Omari by the Court.

Former LSK president Nelson Havi has been stopped from harrassing lawyer Danstan Omari on social media platforms.

The immediate order has been issued by Judge Janet Mulwa of the High Court of Kenya.

” Pending the hearing and determination of this application,restraining the defendant, whether directly or through his agents, servants, or other, an injunction does issue to persons acting at his behest or under his instructions, from posting, publishing, or
disseminating, or facilitating the posting, publication, or dissemination of the words
or images enumerated in paragraph (ii) of this motion, or making any statements of
a similar nature, whether on his Twitter account styled as ‘Nelson Havi’ under the
handle ‘@NelsonHavi,’ or via any other platform, medium, or forum, including
television interviews, radio broadcasts, or public speeches, whether oral, written,
electronic, or otherwise,”reads the order in parts.

The oreder comes after Omari sued Havi for  making  defamatory allegations on his X account on social media against him.

Through his lawyer, Shadrack Wambui, Omari had before suing him, given Havi seven days to retract the accusations and publish an apology in a newspaper with national circulation but he refused.

“Unless an unconditional apology, liability, and compensation are made to our client within the next seven days, we have firm instructions to file court proceedings against you without further reference,” Wambui said in the demand letter to Havi.

Havi later claimed on Facebook as well as on X social media platforms that Omari was among lawyers abetting corruption in the Judiciary and should be removed from the roll of advocates.

Omari’s lawyer, Wambui, termed the allegations false, malicious, and defamatory.

“Our client (Omari) has practised law for many years, and these malicious accusations undermine his hard-earned reputation and standing in the legal community,” Wambui said.

“If he has any evidence about the claims he has made then he can take them to the Judicial Service Commission or the Directorate of Criminal Investigations for proper action to be taken,” added Wambui.
