Four Charged with possessing a Toy gun set free.

The four persons who had been arrested for possessing a toy gun in their vehicle have been  set free.

This is after a Milimani court withdrew that case  on 11th June 2025 after the court was informed that the exhibit was an imitation.

The four, Gin Ammotou, Collins Karani, Brian Mwaniki and Jemimah Kagondo were arrested by the police officers from the central police station who were on patrol on the night of June 5th 2025, and it was during the search that the officers recovered several items including two Samsung S23 Ultra phones, one Samsung Galaxy A04, one iPhone 14 Pro Max, one Redmi 14e, one Infinix 913, one Oppo A5S, a white revolver toy gun, AK-47 CCCP knife, six rubber bullets
Following this discovery, the four were arrested and taken to Central Police Station where they were later brought to court but the Procecution requested for more days for them to conclude the investigation. The four were then taken back to Central Police Station for five days as ordered by the magistrate.
But today on 11th June 2025, the investigating officer stated that they had brought the matter on June 5th 2025 before the court to have the four suspects remanded at Central Police Station, allowing the investigating team to finalize the investigations.
The key exhibit in the case was a toy plastic pistol that led to the arrest of the four suspects, which was sent to the police headquarters. He stated that a report had been submitted to the police, and yesterday on 10th June, he collected a report indicating that the exhibit was an imitation, the officer then conducted discussions with the ODPP’s office, which directed that this miscellaneous case be closed and that the police file be forwarded for further evidence.
After hearing the application, the magistrate closed the matter and released the suspects. “Having considered the application made by the investigating officer and the sentiments of the prosecution,” the magistrate stated, “it has been noted that the investigations have been completed and that the file has been forwarded to the ODPP for further directives. Since the purpose of this miscellaneous file has been fulfilled, the court will allow the application to have it closed. Therefore, the file is hereby closed, and the suspects are discharged pending further directives from the ODPP,” concluded the magistrate.
