A civil Society Group Operation Linda Jamii now wants the appointments of Mr Charles Nyachae and Mrs Joy Mdivo nullified.
Led by its President Professor Fred Ogola, they say that the people of Kenya have fought too hard for democracy to allow it to be stolen through fraudulent IEBC appointments.
“We call on civil Society,religious leaders and all Kenyans to reject this blatant attempt to subvert free and fair elections,”added Ogola.
They want the court to immediately nullify the current shortlist,a fresh, transparent,and lawful selection process that ensures only qualified indipendent individuals are shortlisted.
According to Fred,youths and PWDs get should also get their representation in the commission.
“Election rigging does not start on voting day.It begins with the unlawful capture of the IEBC.The Ruto regime is laying the groundwork for a 2027 election in which the outcome is controlled long before vote are cast”added Ogola.
In a petition filed at Naivasha and Milimani Court,the group is contensting the position of Chairperson Nyachae and Mdivo.
Judge Chacha Mwita according to them has declined to certify the matter is urgent and directed it to be heard on July 28,2025 a decision which they did not welcome very well.
They claim that it does not make sense that a judge in Naivasha can certify this matter as urgent and that in Nairobi gives a contrary opinion.
“How much interest are at play in the formation of the IEBC that the court cannot be independent?”the aggrieved group asks.
He said that the selection panel is full of Ruto regime loyalists while the IEBC should be Independent body.
Ogola claims that it is against the law for Nyachae who is the sitting Chairperson of the Council of Kenya School of Government.
He asks how can a state officer serve in an institution independent of government control?.
Ogola in his petition says Mr. Nyachae is also a perennial government appointee and a recycled bureaucrat whom they believe will serve the current political establishment called the broad_based government and not Kenyan people.
He adds that Nyachae is also listed in CRB and how can such a person be entrusted with 66Billion IEBC who in spite of coming from wealthy family of former minister finds himself on CRB, family financial feuds which are in court and extramarital affairs that have been sued for about four child_support.
He says Mdivo,on the other hand,is the current Chairperson of the Board of Directors at Kenya Power &Lighting Company,a state_controlled entity.
