An advocate of the High court Thomas Nyakambi Maosa Gichana is now in hot soup after being sued for professional misconduct and money laundering.
Maosa is accused of diverting over SHS 62 million to his private account jointly owned by him and his second wife, a Tanzanian national Jane Betty Mwaiseje.
The money was paid to Telenews Africa and Atlantic Region owned by International Journalist Simpson Senda Wa Kwayera.
In affidavits filed at Milimani High Court in case HC/063/2024 top city lawyers led by Edgar Busiega of Busiega Mwanga Advocates, Maosa is also cited as illegally transferring the client’s funds from Sidian Bank Kenyatta Avenue branch to standard chartered bank.
It was at Standard Bank where he wrote scores of cheques for his second wife Mwaiseje to withdraw cash several times per day exceeding the existing government cap of not drawing over one million shilling per day.
Maosa is said to have transported the funds to Dar es Salaam using “panya routes” avoiding official border checks.
The suit papers further avers that Maosa as a result of exposing Journalist Kwayera to massive debts, ill health and untold suffering.
Mr Kwayera has seen his brand new car a Toyota Land Cruiser Prado impounded by auctioneers due to debts.
In the affidavits the advocates are asking the court to compel Maosa to pay the journalist his his SHS 62 million plus compounded Interest and other punitive remedies the court may grant.

The accused had already spent four days in custody but today informed the court that he is unwell and he will be taken to Nairobi Hospital for further treatment as he processes bail.

She added that lawyer Bashir, who is watching briefs for the complainant, has done everything possible to ensure the suspect takes a plea.
The magistrate advised law enforcement officers as per the functional binding constitution 2010.
He faces six fraud charges.
In the first count, he is charged with defrauding businessman Ashok Rupshi Shah and Hitenkumar Amritlal Raja of a parcel of land measuring 7.390 hectares situated in Lower Kabete Road valued at Sh1.3 billion.
He also faces other counts of forgery and uttering a forged document.
The prosecution told the court that Chelogoi forged a letter of allotment dated 31st January 1995 and a certificate of title.
Through his lawyer, Chelogoi asked the court to grant him bail saying that he would abide by the court directions and that he would attend the court proceedings.
Chelogoi had previously failed to honor court summons and despite four previous warrants of arrest being issued against him.
Last week, trial magistrate Alego ordered Chelogoi to appear in court to answer the charges of conspiracy to defraud businessmen.
The magistrate said that this is the last warrant of arrest being issued against him, saying that if he fails to appear in court, then the court will take further action and issue further directions.
A fourth warrant of arrest had been issued against him.
Lawyer Bashir had told the court that the accused wanted to frustrate justice by defying numerous court orders.
His co-accused has already taken a plea and has been appearing in court.
The court, together with the prosecution, victim lawyers, defense, and media, had also visited the hospital ward, where it was alleged to be, but was denied access.
The hospital security intervened and said that the court was in breach of their rules and protocols since they were unaware of their visit to the hospital.
The hospital security team said that the rights of privacy against their clients have to be safeguarded, and in case of anything, the management ought to have been notified first.
Present at the hospital were magistrate Dolphina Alego, lawyers Suleiman Bashir for the victim, and Tom Ojienda for the suspect.
The court had ordered Chelogoi to take his plea where he is by Thursday because of various adjournments that the defense had on several occasions requested.
The suspect is accused of conspiracy to defraud a businessman about a 7.39-hectare parcel of land located in Lower Kabete worth Sh1.35 billion.

He said that he is concerned that there is malice and delay tactics.
Magistrate Alego directed all parties to file a formal application by the next mention date, and they left the hospital.
Alego had issued the order after Chelogoi failed to appear in court on Wednesday for plea taking.
Chelogoi had been scheduled to plead guilty to the fraud charges after failing for a third time to appear in court.
When the matter came up for plea-taking, his lawyer, Prof. Tom Ojienda, urged the court to defer plea-taking, saying Chelogoi is still unwell.
But the prosecution opposed the application for adjournment, asking the court to order an investigating officer to visit Chelogoi, where he is and make a report before the court could issue further orders.
The court was told that Chelogoi has been avoiding pleading to the charges of land fraud since November last year.

The medical document from KNH was produced to court by lawyer Ojienda who sought for more time to have a civil case pending before the High Court.
However, the magistrate in her brief ruling, directed the court to move where Chelogoi is on Thursday at 10 am and take plea in the case.
Earlier, Chelogoi had obtained anticipatory bail from the High Court under instructions that he should avail himself to Court for plea taking only for him to disappear to an unknown place.
However, the prosecution informed the court that Chelogoi failed to comply with the earlier court orders.
“The magistrate had pointed out that the accused was even earlier given cash bail by the Superior Court in a bid to present himself to court for plea taking yet he has not adhered to the same, Court orders are not made in vain.
“In view of the prosecution’s submissions, this court issues a warrant of arrest Against Chelogoi,” the Magistrate had said in her ruling three weeks ago.
In the case, Chelogoi is to be charged alongside the deputy land registrar Andrew Aseri Kirungu with conspiracy to defraud Ashok Rupshi and Hitenkumar Amritlal Raja of their parcel of land valued at Sh1, 350,000,000.
Chelogoi separately faces a charge of forcible detainer of the said land where the prosecution claims that he unlawfully detained the land on unknown dates between December 9, 2020 and December 12, 2023.
He also faces a charge of forging a letter of allotment ref. no.75707/ VII dated January 31, 1995, purporting it to be a genuine and valid letter issued by the commissioner of lands.
He is also said to have forged a signature and stamp impression of a land registrar officer namely Pauline Achieng Pesa on or before January 16, 2023.
Kirungu has since denied the charges and is out on a cash bail.
The prosecution informed the Court that they intend to parade a total of 21 witnesses in the case.
A Total of 17 buyers participated at the auction with five buyers controlling 84 per cent of the total coffee traded..
Coffee volumes increased by 18 percent this week at the Nairobi Coffee Exchange (NCE), a trend market analysts attribute to the registration of more mills and the high demand for clean beans presented for sale.
A market report by NCE secretariat reveals that during this week Sale 21, registered coffee brokerage firms offered for sale 23,930 bags compared to 20,281 traded in Sale 20 last week. Out of which 17,459 bags accounting 73 per cent of all coffee traded were top grades AA and AB.
The report notes that total earnings from the auction reached $7,295,208 ( Sh970 Million) which was a significant increase from $5,786,468.20 (Sh769.6 million) returned during last week’s auction.
The average price increased to $248 (Sh32, 128) from $ 232 (Sh30, 856) per bag, accounting for 6.9 per cent achieved last week. This average price is equivalent to Sh100 per kilo of Cherry at the trading floor. A coffee value chain expert Henry Kinyua explained that the auction has of last If you look at the catalogue that indicates that more coffee is being milled and equally delivered into offered for sale. “The catalogue indicates more mills have been licensed and are now operational and thus easing crushing of parchment coffee and equally, quality has remained impressive,” said Kinyua on phone. Data from the NCE indicated that coffee farmers in the last five months of 2023/24 crop year have received over Sh12 billion through the DSS that was developed by Cooperative Bank of Kenya.
The data indicated that between Oct 1, 2023 and the end of February this year DSS system has settled 17.2 million kgs accounting 339,803 bags in total coffee volumes valued at $89.5million.

In addition, the clearing and settlement of trades through the Co-op Bank’s Direct Settlement System (DSS) has ushered in unprecedented levels of price transparency that has greatly rebuilt the trust that farmers have in the coffee auction and the Nairobi Coffee Exchange.
NCE on August 8, 2023 announced the appointment of the Cooperative Bank of Kenya as the provider of DSS to coffee value chain players after every sale in the country.
NCE secretariat confirmed that the highest price recorded from the sale reached $455 (Sh60, 515) from the Kiamugumo factory of the New Ngariama Farmers cooperative Society in Kirinyaga County. Other factories whose coffee fetched more than $400 (Sh53, 200) per bag include KII factory, Karimikui, Kerugoya and Kabingra from Kirinyaga County. Others included Gichatha-ini, Gakundu, Kamwangi and Kiunyu in Nyeri County. During the auction a total of 847 bags or 4 per cent of all bags traded fetched more than $400 (Sh53, 200) per bag.
Kirinyaga Slopes Coffee brokerage company successfully traded 8,343 Bags at an average price of $292 (Sh38,836) that was also the highest average price by any broker. Baringo Kawa Brokerage Company, the latest entrant, also presented 247 bags for trading and received an average price of $206 (Sh27, 398).
Reigning Kenya champion Jasmeet Chana will resume his title defense next week at the Kenya National Rally Championship (KNRC) Safari Rally (28 – 31 March) in Nairobi and Naivasha.
The former Kenya Two Wheel Drive and Group S champion returns to the national series with a new ride (a Ford Fiesta Rally2), hoping to ruffle feathers against the national speedsters.
Chana aka “Iceman” is upgrading from his traditional championship-winning Evolution 10 to a Rally 2 Ford Fiesta he’ll pilot for the first time over the long sporting Easter weekend.
Iceman will, nevertheless, need to keep an eye on his mirrors, as fellow compatriots Karan Patel, Aakif Virani, Samman Singh Vohra and five-time Safari Rally winner Carl “Flash” Tundo will pilot state-of-the-art Rally2 marques.

Reigning Ugandan and Tanzanian Rally Champion Yasin Nasser of Moil Rally Team Uganda is also in the KNRC mix.
Nasser is contesting a full season of the KNRC this year, chasing an unprecedented hat-trick of championship wins in East Africa.
He hopes to finish as high up in the overall standings as possible in Kenya this season to achieve his intended fairytale hat trick having already finished third in Eldoret’s season opener behind Samman and Chana.

The Ministry of Health ond Doctors have agreed to proceed on negotiations on the matter of the CBA that lapsed.
CS health Susan Nakhumicha while addressing the press said they are looking on how to solve some of the underlying problems.
“As a Ministry we also discussed with the Union on the matters that solidly lapsed in the MOH,” she said explaining that from the matters that the doctors raised, there are those that should be handled by the Ministry and there are those they agreed that the Union move on.
“So on matters that are to be handled by the Ministry, I am happy to report that as a Ministry of Health we have made very good progress, and one of the issues was on the internship programme.
“So we have agreed that they’re going to participate in the review of the internship policy that’s currently ongoing – and chaired by the Acting Director General of Health, Dr. Patrick Amoth – so that we review the policy, and ensure that it’s allied to the Universal Health Coverage and it addresses all the emerging issues that we have heard,” she said.
She said that the Ministry and doctors also agreed to proceed with the negotiations on the matter of the CBA that lapsed.
“The status as it is; is that the Union wrote to the Ministry, and the Ministry had written back with a counter offer, but both parties were yet to sit and discuss,” she said, but pointed out that they have agreed that within this week, the ministry will host a meeting so that the matters that are in the CBA can be addressed and negotiations begin.
“We have also discussed and agreed on the pending arrears for registrars that PS Harry Kimtai is going to take charge and have a discussion with universities so that reconciliation is done of all the outstanding arrears, and equally, we have received commitments from Treasury on availability of resources,” she said.
However, while dismissing the CS’ announcement of a ray of agreements reached, Dr. Atellah called upon doctors working at Kenyatta National Hospital offering minimum services and those working at the Moi Teaching and Referral Hospital, working on the same, to have the matter of strike escalated “so that we can have quicker resolution to it.”
He said in the CBA of 2017-2021, the government owes the doctors’ basic salary arrears of seven years, which several negotiation meetings have failed to unlock over Sh3 billion owed to them.
“We have not seen any commitment to have this paid,” he said, and promised they will shut down KNH and MTRH, noting that over 70 doctors working at KNH have exploitative contracts.
“we want those doctors to be put on the right terms; we have a CBA which SRC has refused to approve for KNH and MTRH and the reason we are going to shut KNH and MTRH to allow SRC to come to their right mind and approve the CBAs,” he said.

An-nadil Jamaly and Ngara Sports Club B will come up against each other in Qualifier 2 – the third play off before Sunday’s eagerly-awaited final of Nairobi Cricket Association (NPCA)
T20 Division Two.
The two teams are expected to unleash their best cricket at Sikh Union ground on Saturday (from 2:30pm onwards), as only the winner will progress in the competition and take on the
fancied Legends Cricket Club team in Sunday’s eagerly awaited Final.
Jamaly topped the Group A log of the league season winning 6 of their 7 group-stage matches.
Legends Cricket Club ,on the other hand, also won six out of seven and finished first on the Group B log.
But Legends secured a passage to the final by defeating An-nadil Jamaly by 7 wickets at Ruaraka Sports Club in last weekend’s Qualifier 1.
Both Ngara B and An-nadil teams know full well the magnitude of Q2 as it will be end of the journey for the team that loses on Saturday.
An-nadil got a lifeline after their loss to Legends in Q1 but now hope to vent their spleen on Ngara B side.
Ali Asghar, Hussein Shabbir and Yusuf Jainuddin are expected to spearhead An-nadil’s top order and so will Jitesh Patel, Murtaza Abass and Bharat Panchasara from the Ngara side.
Whatever’s up their sleeves will be known at the conclusion of Saturday’s March which starts at Sikh Union ground, which also hosted the Super League T-20 Finals last weekend.
Ngara B prevailed to Saturday’s Q2 after defeating Stray Leopards Cricket Club B by 5 wickets at Ruaraka grounds also last weekend.
The conclusion of Division Two T20 season will also see several
standout players rewarded for their exemplary performances across the board.

Meanwhile, NPCA is embarking on a full- blown campaign to elevate the standards of junior and women’s cricket to desirable levels.
NPCA Hon Secretary Narendra Patel aka NK while making the announcement at last weekend’s Super League T-20 Finals, said the initiative is a deliberate move aimed at bolstering the standards of cricket as well as ensuring inclusivity in the sport, by and large.
“Generally, we have had the knockouts after the T20, but because of the current weather issue we have decided to play two tournaments; one will be the junior championship and the other for women during this break of six weeks, we are going to have an Under-19 League and we are hoping to have as many teams participating as possible” remarked NK.
“For the ladies,” continued NK, “we have just brought on board two ladies to help us promote Womens cricket in Nairobi.”
NK added that currently there is only one lady’s team that plays in Division Two.
He continued: “But I understand that we have 40-50 ladies who want to play cricket and so we want to have a specific ladies-only league up and running.”
NK went on to explain that the T20 season has been an eye-opening experience in as far as development of cricket in the city of concerned.
“If you look at the Super Division and Division One T20 season that was completed last weekend, we have witnessed quite a number of youngsters who have performed really well
and that’s a positive sign, but still much needs to be done.”
“We want to speak to the clubs to bring in new players. And also national body (Cricket Kenya) should follow suit,” added NK.

Ian Waihenya Ndungu and Damaris Wakiuru Ndirangu was charged that on diverse dates between March 2023 and September 2023 at Genghis Capital, jointly with others not before court conspired to defraud Sh 17,022,719 the property of Genghis Capital.
Ian Waihenya Ndirangu was charged that between May 2023 and June 2023 at Genghis Capital Limited in Nairobi within County, being an employee of the said company, stole cash worth Sh 10,379,099 the property of the said capital.
Waihenya was also charged with handling stolen property against the law. He allegedly handled 10,379,099 knowing it was stolen property.
Damaris was charged on diverse dates 17, 2023 and April 24, 2023 at Genghis Capital in Nairobi County, jointly with another before court, and stole Sh 1,584,921 the property of Genghis Capital.
They denied the charges before magistrate Susan Shitubi and were released on a bond of Sh 3M each or a cash bail of Sh 1M.
