Man in Sh 7M fraud has been convicted by the court.

A Nairobi Court today convicted a man charged with stealing by servant contrary to section 281 of the Penal Code.

The Court found Elijah Otieno guilty of the offense of stealing Ksh 7,854,000 from his employer Gazlin Energy Limited in 2019.

According to the prosecution, Elijah on October 24, 2019, being an employee of Gazlin Energy Limited stole the said money from the company. The prosecution further informed Court that the money came to the possession of the accused person by virtue of his employment.

In convicting the accused person, the Court ruled that the prosecution had discharged its burden of proof beyond reasonable doubt that indeed the accused person committed the offense of stealing by servant.

The court further ruled that all evidence confirmed that the accused person was guilty of the offense and that any attempt by the accused to exonerate himself from the crime could not hold water.

In mitigation the prosecution pleaded with the court to mete a custodial sentence to the convict stating that it would serve a deterrence effect to other potential offenders.

The court fixed August 1, 2024 for the sentencing.
