The court stops the impeachment of Meru County Governor Kawira Mwangaza
The High Court has given relief to embattled Meru County Governor Kawira Mwangaza by issuing an order stopping her impeachment.
Justice Bahati Mwamuyekawi said, pending the hearing and determination of a petition filed by Mwangaza, the decision by the senate to adapt the impeachment by Meru County should not be published I n the Kenya Gazette.
The judge further ordered that the resolution of the senate should not be published, and neither a declaration should not be made to declare the meru County Governor office vacant.
The judge directed the applicant (Mwangaza) to serve her petition upon the senate to allow it to respond to the constitutional issues raised by the governor.
The court further ordered the petitioner to file written submissions, and the same should be served upon the senate, and the senate will have the opportunity to file the response or a replying affidavit and the matter be mentioned on 17th September to confirm compliance.
The court further directed parties to take hearing dates on a priority basis.
Governor mwangaza was impeached by Meru County assembly on 8th August 2024, and the resolution of the assembly with the proceedings were forwarded to the speaker of the senate.
The Senate, during its session on 21 August 2024, passed a resolution to have Governor mwangaza impeached.
