A case in which Doctor Nisha Supra is accused of Killing her Millionaire husband, yesterday took another turn after her brother in-law insisted in court that She killed him.
When the matter came for hearing before magistrate Benmark Ekhubi,Nisha’s brother in_law Kuldip Madan Sapra said she had confirmed to him that they indeed had an argument with her later husband before he died.
“Soon after she was released from arrest,we met at JKIA and she confirmed that they had argued about a Woman few days before my brother died,I am sure that my brother died of stub wounds inflicted by her wife,”said Nisha’s brother in law Kuldip.
The witness narrated how his late brother died in the year 2005 saying the family is yet to receive justice.
He said that before his brother Yogesh Morgan died,he had told him that his dentist wife had stubbed him causing injuries on his body.
“My brother’s children also confessed to me that their mother stubbed their father at their home during a domestic quarrel,”added Kuldip during his testimony in court on October 17,2024.
He narrated how doctors who were attending his brother had told him that he was in critical condition but will get better.
On August 22,2005 morning, he went back to ICU at Nairobi Hospital where he found that his brother was sedated and at the respirator.He could not speak.He added that his brother was asthmatic and after surgery he did not make it.
He said that from that time to September 8,2005 his brother remained at the respiratory machine,he went through multiple surgeries and passed on September 8,2005.
According to him,his late brother was treated by a multiple of doctors who were principled doctors and treated him at ICU.
“On the 9th September,2005 I informed my family and we started preparing for burial which were made at my late brother’s home,”added Kuldip.
He said Nisha gave him the burial permit and together with his brothers,the dentist,her children,brothers-law had a meeting in her room where they asked to sign a document for the welfare of her children.
“We wanted the inheritance from my brother to go to his children and she sighed the document,”added Kuldip.
On September 11,2005,the witness said he received a phone call from OCS of Spring valley police station,he told him to stop everything and accompany him at the morgue to view the body at Lee funeral,he said he wanted to check if the postmortem had been conducted because he had a report that the late had been stubbed outside his house.
The OCS added that he had a letter where the late had said he would have a party and that the security was to be maintained.
The OCS allowed him to proceed with burial and later cremated him.
He was during that process informed that Nisha had been arrested and taken to Spring Valley Police Station.
All the family and domestic staff”s statements were recorded on September 17,2005.
On October 4,2004 Nisha requested they had a meeting and they met at JKIA and had a long conversation and asked her what happened and asked about her position in the family.
“She said they had an argument with her late husband over a lady he had invited in that ceremony”,added the witness.
After that in inquest was formed and all went through it,the judge ordered she be charged with murder but another judge ruled she be charged with manslaughter.
He added that now 19 years later the manslaughter case is proceeding at the Magistrate’s court.He added that they had a family business and had close relationship with his late brother.
While the witness was cross examined by Senior Counsel (SC) Kioko Kilukumu for Dr Nisha on the cause of death, the witness said the death was caused by an infection at the injury occasioned by the stab inflicted on him by his wife.
However, Mr Kilukumi presented a letter from one the many doctors who attended saying an infection caused the death and not injuries.
Mr Kilukumi said the doctor attributed the death to mismanagement of the patient.
The lawyer also disclosed that the marriage between Yogesh and Sapra was rocked with violence and that at one time the deceased stabbed the accused with a pen-knife.
Mr Kilukumi said domestic workers of the two testified in court that the couple used to fight quite often.
“All that I know is that my brothers death was occasioned by the stab inflicted by his wife,” Kuldip told the magistrate as he concluded his evidence.
At the time of his death,the millionaire had constructed Sh 700Million estate that included several duty free shops at the Jomo Kenyatta International Airport(JKIA).
He was said to have been attacked by unknown assailants at his home in Lower Kabete on the night of August 20 and 21,2005 and seriously injured.
He had been rushed to Nairobi Hospital where he died on September 8,2005 as a result of multiple organ failure and blood infection.
The matter will proceed on November 1,2024.
