A young Man who emotionally posted President Ruto’s Burial charged now wants review of his case.

A fourth year Moi University student who was charged with sharing an image of a funeral procession with misleading caption alluding to the death of President Ruto now wants the Director of Public Prosecutions to review the charges.

Through lawyer Danstan Omari, David Oaga Mokaya asked the DPP to review the charges unless they promise the accused Student that President Ruto will be called to testify in the case.

“The student is charged with publishing a casket on Twitter. I have written to the DPP to review the charges on the citizen’s right to criticize their leader, especially their president,” the court was told.

The Law Society of Kenya (LSK) also told the court that they want to know whether the president will be called as a witness and challenged the jurisdiction of the case.

According to the charge sheet, on 13th November 2024 at unknown place within the Republic of Kenya,Mokaya knowingly published information that of a funeral procession with a casket covered with a Kenyan flag, escorted by military officers in ceremonial uniform.

In the said publication, the student captioned, “President William Ruto’s Body Leaves Lee Funeral Home” over a computer system “X” using account “LANDLORD@bozgabi” that resulted in panic among the public.

The case will be mentioned on January 28, 2025.
