A woman linked to the Dr. Obwaka death case has asked the High Court to release her from custody.
Beatrice Wangari argues that fresh medical findings show Dr. Job Lukuru Obwaka died from natural causes.
She filed an urgent application before the High Court at Kibera.
Through her lawyer, Levi Munyeri, Wangari challenges a detention order issued during the investigation.
Her legal team argues that the post-mortem findings no longer justify her continued detention.
According to the application, doctors concluded that Dr. Obwaka died from cardiac arrest caused by pre-existing heart conditions.
The defence argues that investigators have not linked Wangari to any criminal offence.
Arrest following Dr. Obwaka’s death
Dr. Obwaka died on May 1, 2026, after doctors admitted him to Nairobi Hospital for treatment.
After his death, detectives from the Directorate of Criminal Investigations arrested Wangari as they investigated claims of suspected poisoning.
Investigators later presented her before the Kibera Law Courts.
The court allowed detectives to detain her for ten days to complete their investigations.
Defence challenges detention
Wangari’s lawyers argue that the magistrate issued the detention order before doctors conducted the post-mortem.
They say the court relied on incomplete medical information.
The defence therefore argues that the detention was premature and unnecessary.
Post-mortem findings
Government pathologists conducted the post-mortem on May 5, 2026, at Lee Funeral Home.
The examination concluded that Dr. Obwaka died from cardiac arrest linked to underlying heart disease.
According to the defence, all the medical experts agreed on the cause of death.
The lawyers argue that the findings rule out poisoning.
High court asked to release suspect
Wangari’s lawyers have asked the High Court to review the detention order.
They argue that the medical evidence has changed the basis of the investigation.
The defence also says continued detention violates Wangari’s constitutional rights, including her right to liberty and the presumption of innocence.
The lawyers want the court to release her on reasonable bail while investigations continue.
Wangari’s affidavit
In her affidavit, Wangari says the Chief Government Pathologist attended the post-mortem.
She also argues that investigators do not need to wait for toxicology results because doctors have already established the cause of death.
She further states that the next court mention on May 14, 2026, is too far away considering the new evidence.
Police records
Police records show that Dr. Obwaka’s son, Dr. Christopher Obwaka, and his wife, Everrose Obwaka, identified the body.
The records also confirm that Dr. Obwaka died at Nairobi Hospital at about 6:00 p.m. on May 1, 2026.
Court awaits decision
The High Court will now decide whether to set aside the detention order.
The court will also determine whether Wangari should remain in custody or secure her release as investigations continue.
