Court Upholds Validity of British Man’s Will in Long-Running Estate Dispute
The High Court has upheld the validity of a Will authored by a British national who died nearly 13 years ago, resolving a contentious legal battle over his multi-million-shilling estate and dismissing rival claims from several parties.
Justice Hillary Chemitei ruled that the Will, prepared by the late Roger Bryan Robson in 1997, was properly executed, witnessed, and drafted by a qualified advocate, effectively putting to rest allegations that it was a forgery.
Robson, who died on August 8, 2012, had named lawyer Guy Spencer Elms and Sean Battye as executors of his estate in a Will dated March 24, 1997. Battye later renounced his role after relocating overseas, leaving Elms to carry out the deceased’s final wishes.
Among those contesting the Will were Thomas Murima Mutaha, a businessman and director of Plovers Haunt Ltd—which claims a stake in an Upper Hill property—and Ms. Kagure, who argued she purchased a parcel of land in Karen from Robson in 2011. Both claimed the Will was not genuine.
But in a strongly worded ruling, Justice Chemitei dismissed the forgery claims. “There is no evidence to suggest that the deceased was under any pressure or coercion. It appears he voluntarily visited his lawyer and expressed his intentions clearly,” the judge said.
The court also found no indication that Elms stood to gain personally from the Will, instead observing that he was only acting in Robson’s interest. Robson died childless and had instructed that his assets be liquidated and the proceeds shared between his nephew and local environmental charities.
On claims that the Will lacked a detailed list of Robson’s properties, Justice Chemitei noted this was not enough to invalidate the document. “If any properties were left out, they can be handled as intestate assets. That alone cannot nullify a valid Will,” he added.
The judge cast doubt on the credibility of documents presented by Mutaha, especially those relating to share transfers in Plovers Haunt Ltd. Mutaha alleged he had acquired the disputed land from Robson, but under cross-examination, he admitted there was no written sale agreement and that the property was allegedly transferred to him without payment.
Michael Fairfax Robson, the deceased’s brother, testified virtually and denied any knowledge of Mutaha. He also confirmed a strained relationship with his late brother, which led him to return to the UK.
Meanwhile, Elms defended his role as executor, telling the court that although he once faced criminal charges over the Will’s authenticity, the matter was withdrawn. He further testified that Michael Robson had transferred his shares in Plovers Haunt Ltd to himself and his wife, then formed a subsidiary company—Plover Haunt (2015) Ltd.
Elms also explained that the contested property remained under a bank charge, meaning no valid transfer could have occurred during Robson’s lifetime.
Justice Chemitei directed that ownership disputes involving three contested parcels be handled by the Environment and Land Court. “The matters raised are contractual in nature and unrelated to inheritance. The land court is best placed to resolve them,” the judge ruled.
Kagure maintains she purchased the Karen land from Robson in 2011 for KSh100 million—a claim now set to face scrutiny at the land court.
In a related case, Timothy Wangai Mwathe and Frendrich Pietz had also laid claim to another piece of Robson’s land. However, in October 2024, the court revoked Mwathe’s title and ordered him to pay KSh7 million to the estate and to Elms for trespass.

Following the recent shooting of a business vendor at Nairobi central business during the Tuesday demonstration by unknown Police officer at a close range.
Pressure is continuing to mount on President Dr William Ruto to suspend top security officials at the National police service (NPS) and the director of criminal investigation (DCI).
In a detailed press statement,Sebastian Onyango the chairperson ,The justice and Equality Council a United Kingdom based civil society now demand all the top corps from the two security urgency be suspended over what they have termed it as violation of the constitution.
“We, the Justice and Equity Council (UK Chapter), hereby demand that the NPSC,Immediately suspend or remove the aforementioned officials from their positions” Said Sebastian Onyango.
According to the civil society, the inspector general of police Douglas Kanja, his deputy in charge of the police Eliud Lagat, and the director in charge of national intelligence Mohamed Amin need to be suspended over they termed as failure to protect Kenyans especially during demonstrations.
On Tuesday, business and transport were paralyzed in Nairobi central business following a demonstration by Kenyans and civil society who were demands answers and justice following the crusome murder of Albert Ojwang’ a Teacher and blogger, who died in a police cell at Central police station within the CBD.

UK CALLS FOR THE SUSPENSION OF THE INSPECTORATE OF POLICE AND DIRECTOR OF CRIMINAL INVESTIGATIONSn BY THE KENYA POLICE SERVICE COMMISSION
UK CALLING FOR THE SUSPENSION OF THE INSPECTORATE OF POLICE AND DIRECTOR OF
CRIMINAL INVESTIGATIONS BY THE KENYA POLICE SERVICE COMMISSION
The Justice and Equity Council UK chapter would like to bring it to the attention of the Chairman and
Secretary of the Kenya Police Service Commission, its concern by the continuing forced disappearance,
abductions of fellow citizens of Kenya and lately the blatant killing of a blogger, Albert Ojwang right within
a police cell. This joins a growing list of children of Kenya known to have been forced to disappear and/or
have been abducted or killed over the last couple of months including Mr Gideon Kibet, Mr Billy Mwangi,
Mr Peter Muteti and Mr Benard Kavuli. We demand that the top leadership of the Police service be sent on
compulsory leave and/or suspended and investigated over the failings and killings
These Kenyans are human beings, and you have been delegated the authority under the 2010 constitution
to serve these Kenyans amongst the over 50 million other Kenyans by guaranteeing that officers you vet
and promote to the high office of the police service including the inspector-general and deputy inspector
general have the highest integrity, are law abiding and are devoid of any political inclinations to ensure that
they protect Kenyans from any harm, abuse, torture, degrading treatment, unjust practice and in any case
contrary to chapter 4 of the 2010 constitution covering the bill of rights.
The list of Kenyans who have similarly been forced to disappear or been abducted is growing and we are
baffled by your deafening silence and the silence of your commission which for the time being, is
responsible for the safety and wellbeing of Kenyans in their disparate composition. Further, we have not
seen any tangible action being taken by your office or the cabinet secretary for interior requiring that these
forced disappearances be brought to an end, by the Inspector General of Police, or for him to submit a
report of the status of investigations.
The IG of police has BLATANTLY LIED that Albert Ojwang committed suicide and now offers a lame excuse
after evidence has emerged to the contrary, the evidence of which has or is being tampered with in the
most gruesome manner. The IG wants Kenyans to believe that exposing the rot by a public servant is now a
criminal act that the police can waste public funds in defending instead of the aggrieved individuals filing a
civil case for libel as is the practice.
We can now state that under your watch as chairman and secretary of the Kenya Police Service
Commission, Kenya has been turned into a police state where lives of Kenyans do not matter anymore and
that the reputation of the police service now rank higher above the lives of the Kenyans. WE SAY NO NOT
AGAIN…… THIS CAN’T and WON’T BE ALLOWED TO TAKE ROOT AMONGST KENYANS.
Having lost faith in the ability of the cabinet secretary and president to uphold the 2010 constitution, we
now turn to you as the commission capable of hiring and firing police officers to intervene and do the right
thing. History will judge you once all this has passed and one wonders if your name would be worth the
paper it is written on if lives of Kenyans who pay your wages mean nothing to you.It is in view of this that the purported statement by the Inspector General of Police has to be interrogated
and his sacking and or dismissal need to be your priority in your mandate to ensure Kenyan remains a law-
abiding state with law abiding police officers. Ina properly functioning democracy, the IG, his deputy
Langat, DCI Mohamed Amin would have all resigned or been sacked and investigations would have moved
to a charge sheet of those capable.
