LAWYER DANSTAN OMARI, MARTINA SWIGA SEEKS OVER 60M FROM A REPORTER AND SEVERAL MEDIA HOUSES OVER DEFAMATION CLAIMS.
A reporter employed by People Daily newspaper and several media houses in Kenya have been sued by Lawyer Danstan Omari over defamation claims.
Lawyer Danstan Omari, Martina Swiga and other Lawyers from Danstan Omari and Associates firm are seeking ksh. 10 million for malicious damages from each.
A correspondent with the People daily , The People Daily newspaper, Nation Media Group, Capital FM, Sidney Chazima and Shahidi news have been accused of maliciously damaging the reputation of the said Lawyers through their publications.
Danstan Omari and Associates through their lawyer Omaiyo Aranga has filed a suit before High court of Kenya on the issue of malicious publication that dubbed ” EACC , DCI , Lawyers Danstan Omari, Martina Swiga and all Lawyers attached to Danstan Omari and Associates to be investigated over alleged ksh. 2M extortion allegations.
An allegation which the accused lawyers have strongly opposed and stressed that the allegations are untrue , fabricated , and designed for character assassination meant to turnish the reputations that they have build for many years.
Contrary to the publications, Judge Nixon Sifuna in his lengthy ruling has not mentioned the lawyers accused above to be investigated but said that due to the allegations before court where the Directorate of Criminal Investigations had been adversely mentioned, the said DCI officers should be investigated on the above allegations of attempting to defraud alleged two foreign fraudsters over alleged engagement in alleged illegal business in the Country.
The publications by several media houses in the Country cast aspersions on Lawyer Omaiyo clients on integrity by falsely and maliciously insinuating that the Country’s Veteran Lawyer Danstan Omari, Martina Swiga and all Lawyers attached to Danstan Omari Associates are corrupt and extortionists who conduct themselves in a dishonest manner.
The lawyers in Court documents are demanding unconditional apology in eight hours and earlier retraction of false and malicious stories published about them in all the publications plus the authors of the said articles , failure to which they will file a suit seeking over 50M in compensation for defamation.
Lawyer Danstan Omari, Martina Swiga and other Lawyers from Danstan Omari and Associates are seeking over 60 million as compensation to the alleged defamatory stories published by the said defendants.
“The conduct of the publishers is a clear assault to the respectable lawyers and has cost them to lose valuable business from high valuable clients running into millions of shillings, ” Omaiyo stressed.
The lawyers described the conduct of the reporter employed by People Daily newspaper, The People Daily newspaper, Nation Media Group, Capital FM, Shahidi news as criminal and their integrity questionable.
