A man accused of assaulting a police officer and resisting arrest has been charged at Milimani Law Courts.
Martin Waitima appeared before magistrate Wendy Micheni of Milimani Law Courts and denied two counts of assault and resisting arrest against the law.
The court was informed that on March 17,2022 along Uhuru Highway in Nairobi, willfully and unlawfully assaulted Mark Kirimi Muriara who was at the time of the said assault acting in due execution of his duties as a police officer.
In the second count, Waitima was charged with resisting arrest against the National Police Service Act.
He was charged that on March 17,2022 along Uhuru Highway in Nairobi, resisted lawful arrest by officer Mark Kiriara who was at that time of the said arrest acting in due execution of his duties as a police officer.
Through his lawyer Karera, the accused applied for favorable bond terms saying that he has pleaded not guilty to the charges.
“Since the accused has pleaded not guilty to the charges, we pray for bail terms as the accused was arrested yesterday, “he added.
He added that they have requested the prosecution to explore alternative dispute mechanisms because it’s a common assault.
“We pray that the court allows Alternative dispute solving mechanisms in this case, “he added.
The magistrate allowed their request and referred the matter to ADR.
He was released on Sh 30,000 cash bail and ordered to present one contact person.
The matter will be mentioned on April 1, 2022.
