Eight Kenyans and two foreign nationals facing allegations of defrauding two American citizens of USD159,000 (Ksh19,859,100) in a fake gold scam deal have been arraigned in court.
They have appeared and charged before Milimani Senior Principal Magistrate Robinson Ondieki.
They pleaded not guilty to various counts of gold fraud.
They are Samuel Wathika Gathuru, Moses Otieno Oketch, Patroba Odhiambo Tobias, Elisha Mbadi Kimbero, Teddy Samora Kowino, Kaisarios Loamms, Mugabe Patrick Biriko, Seth Steve Okute, Bruno Otieno Oliende, and Collins Kiprotich Langat.
They were released on bail.
“l find no compelling reasons offered by the Directorate of Criminal Investigations (DCI) to warrant the grant of the custodial orders sought. I find that no evidence has been adduced to show the suspects will interfere with witnesses including the complainants in the matter. The application is rejected and each suspect herein is released on bail of Ksh100,000 each plus one contact person each for the eight Kenyans. For the two foreigners l order each to avail two Kenyan contacts persons to get their freedom pending investigations,” Magistrate Ondieki ruled.
The suspects were released on bail and ordered to be reporting to the DCI headquarters every Friday until investigations are completed. They were also ordered to surrender their passports to the court.
A man has been charged at Kibera Law Courts with Impersonation against the law.
Daniel Kinyanjui Kimani appeared before magistrate Derrick Kuto and denied one count of personating a public officer contrary to the law.
He allegedly posed as a police officer from the Directorate of Criminal Investigations and attempted to evict security guards and staff from a building at Kindaruma mall.
He was charged that on February 1,2023 at Kindaruma Mall along Kindaruma road in Kilimani area, falsely presented himself to be a police officer from DCI and attempted to evict security guards and staff at land premise number LR1/462.
Kinyanjui is said to have gone to a land which had a dispute between a businessman and Kenya China Hawking Real Estate Company and personified to be a police officer.
He is said to have presented the alleged false information to China Companies advocate. The accused pleaded with court to be released on lenient bond terms.
The prosecution led by Allan Mogere did not object to his bond plea.
The magistrate released him on a Sh100,000 bond with an alternative cash bail of Sh50,000.
The court directed that the accused be supplied with witness statements that the prosecution intends to rely on during the trial.
The magistrate directed that the matter be mentioned on February 27.
Four Suspects Found Guilty of Murder of Venezuelan Ambassador to Mitigate on March 10,2023.
A Venezuelan Diplomat convicted together with three Kenyans of the murder of ambassador Olga Fonseca will mitigate on March 10,2023.
Former Diplomat Dwight Sagaray and his three co-accused Ahmed Omindo, Alex Wanyonyi, and Moses Kaly have been convicted of that murder by Justice Roseline Korir.
Korir ruled that the prosecution proved its case through its 37 witnesses and the cause of death of Olga was proved.
The four were arraigned in court today for sentencing, however, Dr. Khaminwa, the lead defense Lawyer told the court it lacked prerequisite Jurisdiction to sentence the convicts.”This Court has no Jurisdiction to sentence the Diplomat. I will file my application to prove to this court that it cannot move a step further to sentence the accused persons, release them.” submitted Khaminwa.Dr. Khaminwa argued that Sagaray, the first accused person was a diplomat at the time of arrest and still enjoys diplomatic immunity.The prosecution objected to Khaminwa’s application stating that Sagaragy diplomatic status were withdrawn by the Venezuelan Embassy after his arrest.”I have listened keenly to Dr. Khaminwa’s remarks, and I have noted that he has raised issues of diplomatic immunity and that would apply to the first accused person who was initially a diplomat. However, the court in a similar matter made a ruling where the learned Judge ruled that the diplomatic immunity of the accused person was wiped immediately his diplomatic status were withdrawn by the Venezuelan Embassy,” said the Public Prosecutor.The Court adjourned the matter to March 10,2023 for sentencing.
A company director has been charged with stealing Sh 4.8 Million.
Bridget Gakii Nyaga a director of Bytech Savanna Limited appeared before Senior Principal Magistrate Bernard Ochoi and denied theft charges.
She was charged together with co-accused Eliphus Mutuma Murithi, Peter Wandabwa Ongoya, Willy Mukiti Malonza and Biotech Organics Limited.
They were all charged with conspiracy to steal and stealing Sh 4,819,000 from Bytech Savanna Limited on July 12,2022.
Gakii was charged in the last count with stealing on similar dates at Co-operative Bank Agah Khan Walk Branch, within Nairobi.
She is said to have stolen the money which came to her possession as a director of Bytech Savanna Limited.
They pleaded with the court to be released on favorable bond terms.
They were released on Sh 1m bond each.

The were charged that on July 12,2022,jointly with others before court conspired together to steal Sh 4,819,000 the property of Biotech Savanna Limited.
They faced a second count of stealing the same amount on similar dates and place.
They denied the charges and were released on bond.
Eight Men Charged with stealing Sh449.6M from NCBA Bank detained till Wednesday.
Eight men have been charged again with stealing Sh449.6 million from NCBA Bank even after they were released in another court on bail.
As soon as Peter Gitahi Wambui, Isaac Kipkemoi, Moses Rono, Collins Kipyego, Maxwell Njamba, Edwin Kipkorir, Gideon Kipkirui and Gideon Kipkoech acquired their freedom from Magistrate Ondieki,on almost similar charges, they were charged again at Magistrate Susan Shitubi’s Court.
They are accused of stealing the money through a mobile overdraft facility known as Fuliza.
Magistrate Ondieki had ordered them to deposit a cash bail of Sh 200,000 each and deposit their travel documents in court.
He also ordered them to be reporting to the Directorate of Criminal Investigations every Friday of the week for further analysis.
Before magistrate Shitubi, they denied several counts of stealing, conspiracy to steal, engaging in organized criminal activities, and possession of stolen property, including identity cards and motor vehicles.
They were charged that they jointly conspired with others not before the court to steal Sh449,647,200 from NCBA Bank. They allegedly committed the offence between January 1 and July 4, 2022.
The court heard that the suspects were arrested in Nakuru and Kitale for stealing the money with no intention of repaying the money.
Mr Gitahi, who was arrested in Kitale, was also found in possession of 14 Safaricom registering machines (MoBiGo) and 10 identity cards.
Their lawyer Felix Kiprono and Ham Lagat,the accused pleaded with the court to be released on favorable bond terms saying that they are men of low income.
“Many of the accused persons are students and have no intention of running away after being freed, “added Langat.
Kiprono urged the court to consider that the accused are still presumed innocent until proven guilty.
He urged the magistrate to consider bail and bon guidelines while delivering his ruling on bond adding that the offense is bailable.
The court will decide whether to release them on bond on Wednesday, February 15
Reedemed Church Administrator charged with possessing Government stores unlawfully.
A church administrator has been charged with illegal possession of government stores
The accused person appeared before magistrate Onyina and charged with being in posession of governemnt stores contrary to the law.
Miss Ann Sally Nanzala Ongola, the suspect was arrested on February 8, 2023 in Westlands Sub-County in possession of a certificate of appointment indicating that she had been given an appointment by superintendent at Kenya Prison service.
She is believed to have forged the said appointment in order to evade traffic police officers at various checkpoints along Nairobi City.
“You are charge that on 8th February 2023 in westlands subcounty within Nairobi, was found in possession of a certificate of appointment of service number 41474 bearing the name of Michael Munyendo a superintendent at Kenya prison service which you showed to traffic police officers when they stopped you for traffic offence” reads the charge sheet.
She denied particulars of the charges with her lawyer indicating that the case was a family matter.
She was however released on Kes 40,000 Bond, the case will be mentioned on February 17.
City Tycoon Mike Maina Kamau has suffered a blow after a Nairobi Court slapped him with costs for seeking adjournment of a defamation case.
Maina had sought adjournment in a case where he has sued former Nairobi Governor Mike Sonko accusing him of interfering with his repossession of the 20-acre plot in Nairobi’s Kayole Estate despite a valid eviction order in 2019.
Sonko was ready to defend himself in the matter but he did not do so because Maina informed the court that his lawyer was not present in court.
The matter was before judge Lucy Mbugua who adjourned the case.
Mr Kamau, the owner of Marble Arch Hotel, accuses Mr Sonko of releasing a recording of their phone conversation in which he insulted the businessman, initiating social media attacks that he claims damaged his reputation and image.
He claims that Sonko called the businessman and in a leaked private conversation threatened to demolish part of his hotel, which he said is built on grabbed land.
According to the city businessman, the phone call recording, which was widely circulated, and the Facebook post, were meant to depict him as someone who is violent and corrupt.
Sonko through his lawyer Harrison Kinyanjui wants the court to dismiss that application saying that Maina does not have any evidence to defend his claims.
He adds that Main has failed to exhaust other dispute resolutions mechanisms sated under the law.
“This petition is incompetent and the court should not entertain it, “said Sonko in his response.
He adds that Nairobi City County Is the owner of the disputed land and it allocated the said land to the people of Nairobi who are residing there.
According to Sonko, at the material time he was the Governor of the Nairobi City County Government, he did establish that the purported “Consent” in HCC 457 of 1999 pleaded by the Petition as allegedly having been between Kamau and the Nairobi City Council was never authorized, or permissible in the circumstances.
Sonko says that his witness S.G maina, Chief Officer in charge of lands in the Nairobi City Government will explain much about it.
