Five men have been charged before a Milimani Court Magistrate for conspiring to defraud a land worth Sh 11 billion in Mavoko.

Five men have been charged before a Milimani Court Magistrate for conspiring to defraud a land worth Sh 11 billion in Mavoko.

The complainant in the case are Drumvale Farmers Cooperative Society members who were represented in court by vibrant city lawyer Murimi Waweru.

Murimi urged the court to grant the accused persons a tough bond terms saying that they were a threat to the witnesses in the case.

He said that the accused persons act violated the constitution hence the need to release them on a tough bond terms

The five; Jeremiah Mustisyah Paul, Mohamed Kuroyow Mohammed, Salat Ibrahim, Omar Khalif Adam, Adow Ahmed and Joseph Njue were charged before Milimani courts where they denied the charges.

The court heard that the accused persons committed the offence at an unknown place and time within the Republic of Kenya with others not before the court defraud the above society 452.0 ha of a parcel of land Mavoko block 12 original no 8529/1 worth Sh 11B by false pretences.

They were also charged with falsely obtaining the registration of Mavoko block 12 No. lR 237120 LR 8529/10 originally 8529/1 measuring 141.0 ha in the name of Ganana Development Limited valued at Sh 3B and lied that they were the bonfide owners of the said parcel of land.

The offence, the court heard was committed on diverse dates between February 11, 2018 and September 2018 and January 7, 2021 at an unknown place within the republic of Kenya.

They were also charged with forcible detainer of parcel No. 237120/10 original 8529/11 on the colour of right held possesion onto the said land contrary to section 9 as read with section 36 of the Penal Code.

The five were also charged with obtaining the registration of the cooperation’s land by false pretences and forging the title deed of the said cooperatives parcel of land contrary to the law.

The five were released on a cash bail of Sh. 500,000 with an alternative bond of Sh. 5 million.
