A case in which a man has been charged in Sh 4.2M fake gold racket will now be heard on November 29,2022.When the parties appeared before principal Magistrate Gilbert Shikwe, for fixing of hearing date,they were informed that it will be heard on November 29,2022.In the case Shikanda Ismail Saleh Abdallah alias Salim has been charged for receiving fraudulently Sh4,260,000 from Amit Srivastava of Ibrahim Ahmed General Trading claiming he was in a position to sell to him 10 kilogrammes of gold.The alleged offence took place on diverse dates in March in Westlands, Nairobi.He was accused of working with others not before the court.Shikanda is out on Sh1 million cash bail or alternatively pay Sh2 million bond with surety to secure his release pending trial.
Reprieve for Governors as Court rules that they don’t need a degree to vie.
There is a reprieve for governors as the court rules that they will no longer require degrees to vie for the seat.
This is after the High court Judge Anthony Mrima declared section 22(ii) of the election Act as unconstitutional.
“A declaration hereby issued that pursuant to article 180 subarticle 2 as read with section 183 of the constitution, the qualification for the election of a County Governor is similar to the eligibility for election as an MCA,” Mrima ruled
This is after a Kenyan Victor Buoga moved to court through lawyer Harry Arunda moved to court to challenge the section saying that it contravenes article 180(2) of the constitution by putting academic degree as a threshold for qualifications of candidates on election for the county governor.
The judge further ruled that the qualifications for both MCA and Governor should be similar.
The judgement shall take effect inthe next general elections.
“A declaration hereby issued that section 22 subsection 2 of the elections act contravenes articlw 180(2) by creating an avenue for differentiation between the eligiiloity requirements netween MCAs and County governors hence to that extent its unconstitutional,” court ruled
According to the act president,deputy president,county governor and the deputy must have a degree recognised in Kenya in order to vie for the seat.

A Chief Inspector of Police who allegedly pretended to be a lawyer has been charged at Milimani Law Courts.
David Ochieng’ Onyango appeared before Milimani Magistrate Zainab Abdul and denied several counts of giving false information to a person employed in the public Service ,impersonation,uttering false document,fraudulent acquisition of public property and Acting as an advocate without qualifications.
The court was informed that on unknown date n December ,2012 at Administration Police Service Headquarters at Jogoo House,Block (A) ,he informed Ms.Margret Karanja ,a person employed in the public Service ,as a police Officer that he is an advocate of the high court of Kenya knowing it was not true.
In the second count,Ochieng’ was charged with uttering a forged advocate certificate of admission to Ms. Karanja purporting it to be agenuine certificate issued by the Judiciary.
He faced another count of fraudulent acquisition of public property contrary to the law on diverse dates between August 2014 to June,2018 ,he is said to have acquired practicing allowances worth Sh 2,469,193 from the Government of Kenya.
He faced two more counts of acting as a lawyer being unqualified.
Through his lawyer Nick Omari,the accused pleaded with the court to be released n a favorable cash bail saying that Ochieng is a man of little means.
“The accused is a police officer and a man of humble earning and I request for a linient cash bail even if it is Sh 30,000,”added Omari.
The accused was released on Sh 500,000 cash bail or a bond of Sh 1M.
A man has been charged with stealing a motor vehicle after he pretended that he has lost his logbook at NTSA.
Felix Oyeit appeared before Milimani Magistrate Wendy Kagendo and denied 4 counts of stealing, forgery,obtaining registration by false pretenses and unautherized access of the computer and cyber crimes act.
He was charged that on July 14,2022 at Uperhillarea within Nairobi County, Jointly with others not before the court ,stole a Toyota Axio Valued at Sh 1,050,000 the property of Simon Haron Oruchum.
In the second count,he was charged that on July 13, 2022, he forged an abstract from police records for a loss of a logbook purporting it to be a genuine abstract from police records issued at Buruburu police station.
In the third count, he was charged that on July 14, 2022, at National Transport and Safety Authority(NTSA) headquarters, WILLFULLY PROCURED A DUPLICATE MOTOR VEHICLE LOGBOOK by pretending that he had lost a logbook for Simon Haron Oruchum, knowing it was untrue.
In the last count, he was charged with temporarily causing a computer system to perform functions by infringing security measures with intent to gain access to TIMS account of Simon Haron knowing it was unauthorized, and changing the phone numbers of the complainant.
A Sh 3 million fake gold case against two traders continues at the magistrates court
A witness narrated to the court how he and his team of police detectives used intelligence information to arrest two prime suspects who allegedly defrauded $30,850 equivalent to Sh3 million from a foreign trader by falsely pretending they could sell him 10kg of gold.
the witness, Stanley Mesembi from the DCI’s Transnational Organised Crime Unit told Milimani trial magistrate Caroline Njagi that they arrested Mohammed Akabar Rashi alias Ammit Gathi and Yulian Stankov Pentrov alias Vikta Rosta at Lavington Mall after hunting them in different places without success.
The officer was testifying in a case in which Rashi and Yulian are charged with obtaining 30850 US dollars from Laxmi Narian Jildal by falsely pretending that they were in a position to sell him 10kg of gold.
They have since denied committing the offense between February 27,2019 and April 27, 2019 in Nairobi county.
Yulian alone is accused of being unlawfully present in the country without valid documents from the Immigration Department in contravention of the Kenya Citizenship and Immigration Act.
The court heard that during the arrest, the accused persons were found with proforma invoices belonging to Air Cargo Limited.
Mesembi told the court that the complainant reported the matter after at DCI’s office headquarters where he and his team of detectives started hinting at the suspects. He said they first laid an ambush at Diamond plaza in Westlands but the suspects never appeared.
“Your honor using intelligence information we proceeded to Lavington Mall in Westlands where we laid ambush and manded to arrest Rashi and Yulian,” said the witness.
Prior to the incident, DCI George Kinoti had warned that foreign businessmen trading in gold will have to be subjected to compulsory scrutiny by government agencies before being allowed to continue with their activities.
The DCI said that the country has experienced rampant cases where con artists defraud unsuspecting individuals by selling them fake gold.
“DCI attention has been drawn to an upsurge in criminal cases involving the procurement and sale of gold in the country. The gold scam has now reached alarming levels as unsuspecting foreign nationals are being swindled large amounts of money by the fraudsters,” he said.
They urged high commissions to join the fight against the vice by advising their nationals engaged in trade to follow procedures.
“We urge the embassies (High Commissions) to advise their nationals coming in for business to be apprised of the con business of gold going on in the country and first contact the Department of Mines and Geology for the procedure that pertains to buying and selling of gold and other precious metals,” DCI said.
City Lawyer Evans Ondieki Condemns Politicians who are rebuking Supreme court Judges..
A city Lawyer, prominent Lawyer Evans Ondieki has condemned politicians who are rebuking Supreme Court Judges after the verdict on presidential election petitions.
“It is very unfair for politicians to abuse Supreme Court Judges who are innocent and have no forum to defend themselves,” added Ondieki.
While speaking to the members of the Media outside Milimani Law Courts, Ondieki said that Judges represent the will of the people and the verdict needs to be respected.
“The Judicial Institution is Independent and has an autonomy of the people, Judges should be respected and not to be scandalized, “He added.
He said that Azimio Political Party Raila Amollo Odinga has no right to abuse the judges who cannot even call a press conference to defend themselves adding that if the verdict had been favorable to him, he could not be abusing them.
This comes few days after Opposition leader Raila Odinga rebuked the Judiciary as he expressed his disappointment with the Supreme Court’s judgment on his presidential petition terming it “judicial thuggery.”
The Azimio-One Kenya presidential candidate also threatened to lead a “one million march” to the Judiciary to protest its ruling on the petition.

On September 6, 2022 Kenya’s Supreme Court upheld the election of Deputy President William Ruto as the country’s fifth president, dismissing petitions to overturn the vote.
“IEBC carried out verification, tallying and declaration of results in accordance with provisions of articles 138 (3) (c) and 138 (10)” Chief Justice Martha Koome said while reading the verdict of the court.
The seven judges of the Supreme Court made a unanimous decision to uphold the election results. The judges are Chief Justice Martha Koome, Deputy Chief Justice Philomena Mwilu, Mohamed Ibrahim, Smokin Wanjala, Njoki Ndung’u, Isaac Lenaola and William Ouko.
A company director has been charged with Sh 4M theft case at Milimani Law Courts.
Bridget Gakii Nyaga and Elphus Mutuma Murithi charged that on July 12,2022 at Co-operative Bank Agah Khan Walk Branch,within Nairobi County in the republic of Kenya being a director of Bytech Savanna Limited,stole Sh 4,819,000 (Four Million,Eight Hundred and Nineteen thousand shillings),the property of Bytech Savanna Limited which came to his possession as a director of Bytech Savanna Limited.
In the second count,Nyaga together with Elphus Mutuma Murithi were charged with conspiracy to defraud against the law.
They were charged that on similar dates and place within the country,with another not before the court conspired to defraud Sh 4,819,000 by falsely pretending that he had supplied 580 Liters Pathway,and 1550 bags plant protection Gypsum to Bytech Savanna Limited,a fact they knew to be false.
He was released on a Bond of Sh 1m or a Cash Bail 500,000.

The Walk Children’s Centre -rescuing Nakuru;s poor kids from Garbage collection
One Man has managed to positively change the fortunes of hundreds of street children and the poor in Nakuru Town.
The Man, Pastor Alex Maina, was inspired by a casual walk he took 10 years ago around London estate.
During the evening stroll, Pastor Alex was shocked to see women, their husbands and children scavenging for valuables in the dumpsite.
He said after a few days, he noticed that the children do not attend any school but will always help their parents to scavenge.
He was disturbed and wondered what to do!
“This is what inspired me to start the Walk Children’s Centre and the Walk Academy. I started Empowering kids by giving them education in order to cut the cycle of being street kids. Their parents were scavengers and they influenced them to be scavengers too,” he said
Pastor Maina added that he also started guiding and counseling sessions where he talked to Parents on the need to take their children to school.

He added that he was happy with the reception because most parents embraced the idea of taking their children to school.
Resident Lorna Vidija who comes from the informal settlement said her Kids were taken to the Walk and are now doing well.
“I pray that God blesses my children. Let them go to school and succeed so that they help me in future. For me, had I gone to school, I would not be scavenging for valuables in the dumpsite. Even my grandchild schools at the Walk and I trust that the chain of scavenging for valuables will be broken,” she said.
For the last 10 years, the Walk has been offering free Education to poor children from the informal settlement around London estate in Nakuru.
The Centre has helped reduce the number of street families in Nakuru too.
383 students are currently at the school, they receive free lunch and are given free education.
Pastor Alex Maina depends on his businesses and Well-wishers to support the Centre.

KMJA applauds Supreme Court Judges Over presidential Decision.
Kenya Magistrates and Judges Association (KMJA) have applauded the Supreme Court of Kenya for delivering a upholding the rule of law in their decision.
Through Its president Derrick Kuto, KMJA also applauded Chief Justice Martha Koome for her exemplary leadership to the Institution of the Judiciary.
“Her achievements in a short time are massive,” added Kuto.
They say that they acknowledge the Industry and hard work from the learned Judges of the Apex Court. In the breath, they applaud the members of the bar for their commitment and contribution to the rule of the law.
Kuto says that the Judges managed to decide the matter within the set Constitutional timelines that is 14 days.
They said that time without a number that Kenya is a country Governed by the rule of law and Constitution.
“We believe in the Independence of the rule of law and Constitutionalism. We believe in the Independence of the Judiciary and we urge all to abide by not just this Supreme Court decision but many other determinations that courts at all levels render on a day to day basis,” added Kuto.
On September 5, 2022, the Supreme Court of the Republic of Kenya rendered its decision and upheld the election of William Ruto in a unanimous decision.

Elijah Omollo appeared before Makadara Law Courts Chief Magistrate Francis Kyambi and denied the charges.
He was accused that on May 16,2022 in Nairobi with intent to defraud,obtained the money from Zeitun Ibrahim Issack by falsely pretending that he was in a position to facilitate her to get a scholarship to study in the United States of America.
Through his lawyer Hassan Nandwa,the accused pleaded with the court to be released on favourable bond terms saying that he is a family man.
‘My client has a wife and kids and therefore not a flight risk,”he added.
The prosecution did not oppose his release on bail but requested the court to order him to release his passport in court since he has dual citizenship.
They said that the lecturer is also an American citizen and therefore a flight risk.
Magistrate Kyambi released him on Sh 300k cash bail and ordered him to deposit his passport in court and only make request formally when he needs it.
